    • So a little update.  I sent a complaint to ico and have heard nothing. I just got the general reply email and that's it.  Sat twiddling my thumbs and thought about what I should do next. I searched for the CEO of Studio but then found that he'd left so as keep getting letters from studio about the arrears etc. I thought I'd email the David Twigg. Sent him all the bumpft and a copy of my original complaint and sars request.  Got no response. So didn't know what else to do. Then I thought I'd try through the financial difficulties option on the online form. One last try before I just give up and let them default me.  Then on the 5th June. I got an email from their customer services. That the items that had gone AWOL have all been cancelled. Nothing else on that email, so I had a look in an email account that I don't use anymore and there was an email from the customer service.  That they were sorry for the problems I've had for the last 9 months. That the sars info was emailed to me on 14/04, it wasn't I've kept all spam and deleted emails on that account, they have raised a complaint with their studio pay team regarding the issues, balance dispute, fee's and my credit file. They are hoping to resolve in 3 days but they have upto 56. They also said in regards to my other issues I have to raise a complaint with studio retail but haven't told me how I do that.  The sars info only goes upto the end of December 2023. It has my previous complaints on there but nothing after so I don't know how I get hold of that information. Luckily I've kept copies of every time I've contacted them. Every web chat or social media contact.  Apologies for the extremely long post but I wanted to add everything I could just incase.  I have checked my account balance and it's still minus 900 odd pounds but I'll keep checking to see if it's all cleared and on my credit file.  I'm hoping this is the end of the whole debacle and they close my account because I never want to do this again. Although it's been a learning experience.  Thanks to dx100uk for pointing me in the right direction. Much appreciated.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

 

Thank you all so much for your invaluable help so far, this place is amazing and I am incredibly grateful that so many give so much information freely to help others.

 

I have another question for you all.

 

I CCA'd HSBC for a Harvey Nichols account card and MBNA. MBNA sent the debt to RMA who were constantly calling but have now stopped since receiving a letter from them saying they will send the debt back to MBNA. In the meantime I also sent account in dispute letters as neither HSBC or MBNA have ever bothered to send my CCA.

 

So my question is where do I go from here? Do I sit back and wait or think about sending a full and final settlement offer?

 

Am I ok to continue not paying either of these accounts?

Hi all,

 

I've just been sent a default notice by HSBC for a Harvey Nichols store card which they actually no longer run. It appears to have been incorrectly served as it was dated 14th May and gave me until 28th May to sort out but the letter wasn't received until the 18th May. I CCA'd them back in January and they responded saying I needed to sign my CCA request. I signed the letter and placed a grid of X's over it to avoid any possible lifting of signature. I waited a further 30 days and heard nothing so sent account in dispute letter then stopped payment in March.

 

I have heard nothing from them since until receiving this. It seems they think they can simply ignore my request despite confirming receipt and of course keeping the £1 postal order.

 

Could someone please advise as to a letter to send to them

 

It's funny that HSBC would go in all guns blazing like this when MBNA, who've I've not paid since January for failure to produce CCA, are still just sending nasty letters??!!

WITHOUT PREJUDICE/ACKNOWLEDGEMENT OF ANY DEBT

 

 

Dear Sir/Madam,

 

Re:− Account/Reference Number - xxxx – Harvey Nichols Account Card

Your ref: xxx

Thank you for your letter dated 14th May 2009 the contents of which are noted.

In your letter you make reference to a default notice.

 

In the first instance I must point out that this letter was not received by myself until the 18th May 2009 which therefore makes your proposed default notice invalid as it did not give the required 14 days to allow any possible action to address any possible issue.

 

Furthermore you will find enclosed with this letter copies of correspondence from myself to HSBC requesting a copy of my consumer credit agreement as is my legal right under the Consumer Credit Act 1974, which as noted on the “default notice” you are fully aware of. Within the enclosed letters you will also note correspondence from HSBC confirming receipt of my request and asking for a copy of my signature (dated 15th January 2009) and also a further letter stating why you are requesting a copy of my signature (dated 20th January 2009). Both of these letters were responded to by myself and theresent letter of 13th January 2009 included a copy of my signature.

 

I received no further contact from yourself with regard to my request for a copy of the consumer credit agreement and sent you a further letter putting said account into dispute (letter dated 23rd February 2009)

 

As you have consistently failed to comply with your legal obligations and have also served a “default notice” on an account which was already put into dispute on the 23rd February 2009 I must now insist that any further action by yourselves be ceased with immediate effect. In addition to this I do not give my consent nor agreement for HSBC or it’s associated companies or any debt collection agencies you may use to pass on any information regarding myself not limited to financial details to any other company or organisation.

My request for a true copy of my credit agreement under section 77/78 was made on 15th January 2009and the 12 working days for your compliance expired on 30th January 2009.The account was put into dispute on the 23rd February 2009. Until a true copy of a credit agreement is produced by yourselves you are not at liberty to contact me requesting payment nor am I at liberty to offer any such payment.
