Despite formal demand the def has failed to pay the debt and the claimant claims £300  and further claims interest pursuant to s69 of the CCA 1984.   What is the total value of the claim? £385   Have you received prior notice of a claim being issued pursuant to paragraph 3 of the PAPDC (Pre Action Protocol) ? Yes   Have you changed your address since the time at which the debt referred to in the claim was allegedly incurred? No   Is the claim for - a Bank Account (Overdraft) or credit card or loan or catalogue or mobile phone account? Energy debt   When did you enter into the original agreement before or after April 2007 ? After   Do you recall how you entered into the agreement...On line /In branch/By post ? Moved home and they were the current energy supplier    Is the debt showing on your credit reference files (Experian/Equifax/Etc...) ? No   Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. Debt assigned to JC International   Were you aware the account had been assigned – did you receive a Notice of Assignment? Not sure probably  Did you receive a Default Notice from the original creditor? Again can't remember but probably    Have you been receiving statutory notices headed “Notice of Sums in Arrears”  or " Notice of Arrears "– at least once a year ? No   Why did you cease payments? Changed supplier   What was the date of your last payment? Never    Was there a dispute with the original creditor that remains unresolved? No   Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? No  
    • Their FAQs state - Cancellations and modifications If your booking has been cancelled, Booking.com refunds you immediately. The processing time may take 7 to 10 days and depends on your bank. If you have questions, contact your bank directly. I'm a regular Booking.com and AirBnB user.  The former have never cancelled.  The latter have and my money was refunded immediately (not that that helps you as we're not talking about AirBnB!) Best to check with your bank and see (a) if you did pay in advance and (b) if it has been refunded. Also, have you received a message from Booking.com officially stating the cancellation?
    • I'm not up to date with the Legal Aid rules but I'm not sure that many people qualify. HB
    • You question timescales a bit in thread - From my experience, defaulting everything and ignoring all non PAP letters, while making no payments: - 18 months to LOC - further 18 months to be at court Most are still silent 3 years in though!. If making token payments, court, if ever would be 4-5-6 years from now - Hope that helps. My debt is similar, I started it 2021 and wouldn't believe I'm already over half way through default period. You need to make the decisions but follow advice already given in this thread, and you will be fine. Best time to plant a tree was yesterday, second best time is today. Good luck BT

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,

 

I have not received any reply to the above letter that Ida very kindly supplied for me, I sent it registered post on 1st July. But I dont think it matters because of the following:

 

things have got a bit confusing my friend first sent the CCA and gave me the reply that I have posted on here I then used the account number from the details to do the SAR. I have now been told by my friend that they have noticed the aaccount number is wrong. So I have checked all the information and have found that he sent the CCA with the correct account number the information he was sent from HSBC was for a previours account he had with them, I then sent the SAR with the wrong account number.:confused::confused:

 

So I think I am probably back to the begining and have to start all over and send another SAR, what do you think?

 

I know they have no contract so they really dont have any thing to reply with. My friend had a credit card with HSBC that was cancelled when he transfered the debt to a flexi loan they then issued another card a few months later with a different account number.

 

Any help would be great as I am starting to feel like I am getting no where.

you don't need to send another sar as they should supply all the details for ALL accounts. A sar is for all the details a company holds whether 1 or 10 accounts.

I am not sure what to do then as they have only supplied details for 1 account not the 2 nd they have not complied with the SAR and they have not responed to the lst letter:mad:

Accordingly, I have to tell you that you have not yet complied with your obligations under the Data Protection Act 1998.

 

The time for compliance with my request has now expired. If you do not comply fully with my Subject Access Request within 7 days, I shall apply to the County Court for an order to enforce compliance, together with damages at the discretion of the court.

HSBC will ignore your letter, as far as I can tell that's there policy, they denied ever receiving my sars request, until I provided proof that they had cashed my cheque & proof of special Delivery.

HSBC don't have most of the agreements default notices etc. (Inside info)

Email The Chief Executive Stephen Green. Stephen Greens email won't accept external emails.

But you can email his PA. [email protected]

to be forwarded to Stephen Green

I would copy it to the OFT & Tower Hamlets TS [email protected]

Tower Hamlets are the Home Trading Standards for HSBC.

You might think you aren't getting anywhere with the OFT and Trading Standards, but the more complaints the better. Sooner or later they will start taking notice.

I have done what you have both suggested and am now back playing the waiting game.

 

I really think HSBC are going to make this as difficult as possible:mad:

 

Oh well thanks to this wonderful forum they will have a fight on there hands.:D

 

Can't wait to post the next update, hopefully it will be very soon and far more informative than any of the rubbish they have sent so far, but I won't hold my breath.

Pretty much to be expected with HSBC! They seem to think that the Dataprotection act, CCA ETC DOESN'T APPLY TO THEM.

Have you complained to OFT & TS?

Make sure you keep badgering them all.
