    • I have just read the smaller print on their signs. It says that you can pay at the end of your parking session. given that you have ten minutes grace period the 35 seconds could easily have been taken up with walking back to your car, switching on the engine and then driving out. Even in my younger days when I used to regularly exceed speed limits, I doubt I could have done that in 35 seconds even when I  had a TR5.

    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

i want to know how they got my details , as BT have no recored of them getting in contact with them about my account .( i would be phoned if they did)

 

also the IP stated is not mine ,86.161.17.182 was the ip given on the letter it belongs to BT Central Plus witch is in england not scotland where i live . i asked if they could serch to see if my house had ever used the IP and there reply was it would be very dificalt to do so but she never seid it wasent inposable?

 

i dont have the song in question on my PC , my dad thought it was a game lol . id aparently used Bittorrent

 

the orginal rights owner is DigiProtech Gesellschaft zum Schuzte Digitaler Medien mbH (Schuzte Society for Digital Mediain *in english*)

 

i do want to know how an IP can be used in court ? as im not a business and do not have a static IP so it changes all the time , the date was on the 28.05.2008 just seeing if any one elses is the same

 

i have a good knolage on computers and the internet , and my dad dose not , i dint download/upload it and know way on earth would he been able to!

My father recieved one of these letters today and it left him very concernd.

He has been accused of downlaoding 'Scooter - Jumpering all over the world' in may 2008. They are demanding at fee of £500 after obtaining evidence from BT. They are claiming to be working in behalve of 'Digiprotect GSDM'

He is a pensioner and doesnt have a clue how to work a PC let alone wanting to downlaod 'scooter', and who can remember what they were doing on an exact date over a year ago?

 

I have told him not to pay a thing as he has done nothing wrong.

 

What is the best course of action to take? I have read loads of threads on here but it would be nice to have a diffinative answer of what process to follow and any templates for letters if they need to be sent.

Yup, me too. Same artist, different song and £500.07. This should be particularly interesting as I believe that we were all at a Rugby festival at the time of the alleged offence.

 

Those others of you receiving letters today, Sky customers perchance?

 

Final question, should I send my LOD recorded/registered delivery?

You dont need to do anything.

Do not reply to this letter & i encourage everyone else reading in not to reply either.

The whole thing is nothing but a [problem] & this ACS:Law are legally not entitled to a penny off anyone.

Only a county court has this power & it will cost them money to take people through the county court system, which wont be worth their while to just receive £1 per month back if anything at all.

They are relying on people paying up out of fear.

Simply report them to the OFT & trading standards.

The more people do this, the sooner action can be taken against these rogues.

After reading all the thread ppl seem to be advising that the worst thing to do is ignore it and instead write a letter of denial.

 

If anybody who recieved these letters has ignored / written back then can you please let us know on here and what had happened since you did so.

 

i know this happened alot at the start of may so something must of come around by now.

I found this site via Google after I recieved one of these claim letters asking for £500 from ACS:Law after allegedly aquiring Scooter:Jumping All Over The World last May.

 

My ISP is also Sky Broadband..............coincidence?

is from ACS:Law, same format as letters recieved by others, demanding payment.

send denial and tell them no more PING PONG MAIL prosecute or shuttup see you in court...not a thing on this earth can prove you have actually downloaded so tell em stick it where the sun dont shine

hi

i too received a letter today about scooter jump over the world , im an older lady not interested in that kind of music, i asked my sons who do not live with me if they had downloaded it but they said no, they have a day and time on letter 11/6/2008 at 6 am and have asked for £500 compensation , i have been reading on other forums and most say it is best to return a letter of denial , i think this type of harrasment is terrible as it frightned me this morning when i got this and i am not sky im tiscali who im gonna phone in morning to find out if they gave them this info as acs state they did

I got a letter about "Scooter - Jumping all over the world" this morning too, demanding £500.04. They claim the downloading date was 12/05/08 and then later say the album was released 10/10/08, 5 months after I (allegedly) downloaded it!

 

Surely there must be something we can do more than just complaining? Can they be sued for extorsion or illegally obtaining details (name, address etc)? I've no idea about the legal side of this stuff but there must be someone on here who knows?

 

I'm not bothered about money I just want to screw them over :mad:

My ISP is Be Broadband - I only started service with them 05/2008 so I'm trying to find out an exact date of when it went live.

According to the woman at Be my line went live on 12/05/2008, same date that they're claiming on the letter. However my first invoice states the 14th.

 

Also, there's no comments or marks on my account about anyone requeting my details.

Why dont we all try & turn the tables on ACS:Law in some way?

Yes we can report them to all the authorities etc....

But we as the general public/consumers/citizens need to join forces & fight back against these rogues and teach them a lesson they'll never forget.

I'll throw this open to others to try & come up with some ideas ;) (nothing illegal etc..)

They must have sent out thousands of these letters in the hope people will just cough up. (Hmmmm wonder how many have?)

 

Write back to this shower and deny flat that you did as they suggest. Even if you did:-o, due to a number of reason already stated on this thread, the chances of them proving that in court are remote.

 

Just stand your ground.

This issue is now a very serious 1 indeed as so many people are being targeted for money.

Would it be worth everyone contacting the main police/Scotland Yard about this? (not 999)

I was also thinking along the lines of setting up a petition on the 10 Downing Street website to bring it to the PM's attention?

There are so many other things we can do to run along side all the complaints to the usual authorities etc...

They have got court orders that allow them acces to our info.

ACS: Law register as Data Controllers with the ICO on 14/05/09 so that they may lawfully receive and handle personal information from ISP.

I got my letter today for downloading / uploading Scooter - jumping all over the world, through Bittorrent. 151.88 file size/

Written my LOD ready to send out just before the 21 days are up, (Just in case ACS fold up like DL)

My mum also recieved a letter today, saying we had downloaded the scooter cd and demanding £500. Firsly we noticed a line of our address was missing, in which if they had got the information from bt, the line would have certainly been there. Then I went on the website and noticed that the phone number and fax number were differerent to the letter, and then my mum rang the website phone number, and noticed the phone ringing sounded like it was being diverted to another number. Then when she spoke to someone, they gave no answers to any of her questions, and then said they would ring back with the answers, which they did not. Then later we noticed the IP address was incorrect, and when i looked on an ip locator and the fake IP belonged to someone living in Bristol but we live in west dorset.

i am with sky but i have just discovered after receiving that letter that its easy net which is owned by sky. phoning the customer service is like hitting head to a brick wall. most of the customer service staff have no idea what you talking about.

i dont know where ACS law got informations from but as sky have informed me ,they were given to Devonport Lyons in December 2008 and the alleged download happend in may 2008. i am trying to get further details

have been doing reserch all night.this is what it all boils down to.

this seems to be a second company to do this .thousands of people are getting the same letters so calm down .

the same songs games etc keep coming up it seems to be a templete letter.

the letter you received is technically legal so dont ignore it it seems if you do they try harder to take you to court so send a letter of denial within the 21 days.

one question i would like to ask is who is chief master winegarden as the information i reserched tonight his name is the only one that keeps coming up when the court orders are giving out!!!!!!.

just out of interest how can they tell what file and program was used im sure your ISP cant they can just tell you the traffic leval?

 

surly this then means they can access my family bank details and other privet information ?

 

and about the IP address others are on about , unless your service provider can confirm for you dint used that IP then you could well of have because unless your households are using business internet your IP is public and not static , and that basicly means unless you have asked fora static IP , then your IP changes every so often . not trying to condem them in any way just thought you should know that.

 

i want to know where there getting the number for the sumbs? 500.7/.4 is a picky number imo , its not a court ordered fine so why the .07p ect ?

 

 

edit: Digiprotect is German we all agree yeh? dose German laws affect us UK citizans?
