10.30 am call to my mobile on Sunday morning! The first time MBNA or their cohorts have attempted to contact me on a Sunday to my knowledge. I have only just noticed this morning and it did show the number but again I can't believe that contact on a Sunday morning is within the rules they are supposd to follow?

Hi Capricorn1601, yes I use whocallsme but it's not much use if the number is witheld! Those are the calls which annoy me the most.

 

You may have a facility to block withheld numbers. The usual code is *227# to switch on, *#227# to verify present state and #227# to cancel

I don't think it works for international calls anyway. If a number is withheld upon dialling 1471 the message usually says "the caller withheld their number" but if international it says "it has not been possible to give the caller’s number" or words to that effect. So, I think that if the call originates from a foreign land that you might not be able to block it. Have you thought about getting a Skype (or similar) number in the UK and giving that to your creditors. You can then screen who is calling and let those that you don’t want to talk to go to your answering service.

In the last letter from the infamous Martin Supple MBNA gave me until 26 June, (last Friday) to contact them to discuss repayment. I had 4 attempts by them to call me and a text message yesterday but today it has gone eerily silent. Anyone knows what comes next? DCA time I guess?

Attached acknowledgement of my complaint letter dated 17/06/09 although they do not refer to it directly as this.

 

Have to wait and see what they come up with by the 20 July 2009. I might not see it until August however as they continue to send letters my Ist Class post, not airmail when I am not in the UK. Brainless!

They must have been having a mid-week break as having had no calls since Monday 29/06/2009 I had a call to my mobile at 8:12am this morning. Breaking the rules again as I believe calls should be only made between 9am and 9pm, but we know they don't obey any rules! I ignored as always but true to form they have ignored my written request not to call me.

Oh that's interesting; calls 9-9 only. Although I'm seldom getting calls these days at one time we had no need of an alarm because between 8am and 8:20 I was guaranteed at least three phone phone calls from HBOS and MBNA (2 accounts with each).

Not sure but think the 9-9 rule might only apply to cold calling. I have tried to find info to confirm if they can call at any hour of the day within Ofcom rules/guidance and in other places but frustratingly can find nothing so maybe they can!

It isn't even mid-day and I have now had 4 calls to my mobile and one to my home number!

No more calls received on the 3rd July but then 3 anonymous calls followed by an anonymous text on the 8th July, and yes I have told them to write only. Nothing since nor any more letters.

Latest nonsense from MBNA attached.

 

This is for one of two accounts with them. This one they have been unable to send the agreement for so far and have requested it from HBOS. All they have ever sent me for this account is the current T&C's!

 

I will be replying with a short letter stating no agreement, no payments!

Forgive me, exchange, but their letter states that they have complied and have given you the necessary info, so, perhaps a short letter is inappropriate in this instance. It might be better to go through all their points in the recent letter and your past correspondence to highlight where and how you believe that they have failed to deliver. I doubt they will read it or respond but at least you will have documentary evidence of your grievance which could be presented in your defence should ever reach the court.

Thanks Coactum, I am sending a more detailed letter as when I started writing it I couldn't help saying a bit more than I indicated above. Like you say, the chances of them actually reading what it says are remote but thanks for the sound advice.

Received one of MBNA's nice postcards today. I have seen on other threads that this means expect a telephone call, not a home visit.

 

What gets me is they have written to me saying they won't call until after the 22 July at the earliest, now I get this.

 

Dates seem to be difficult for these muppets as they couldn't work out the start date of the week and messed it up!

 

Also note that it has a 2nd class postmark but they think sticking an airmail sticker on it will make it OK to my overseas address! Show's how long it took as I believe the date is supposed to be w/c 13/07/2009 and it is now the 17th!

I was about to say I knew you were abroad but had no idea you were so far east that it was already tomorrow, then I scrolled down and saw your correction.

 

I've had many of those cards over time and it has never lead to a visit. The card is designed to give the impression that a visit is imminent but I think it is only to scare you. That said they usually don’t even phone on the date on the card either!

Personally I hope they do send someone, I'm just ready for a face to face with someone, it may well go something like this blowup.gif

Has anyone actually received a properly formatted, in the legal sense, default notice from MBNA followed by proper termination?

Am I right in thinking that they only ever send out the comic book version of a default notice, which I received and attached in a previous post, and never terminate the agreement but just keep ploughing on trying to extract money from us?

I really feel sorry for MBNA after hearing that Bank of America only showed an April-June 09 net profit of $3.4 billion (about £2 billion) compared to $3.2 billion in the same period last year. Sounds like they're really struggling then!

Did you forward that card to me? I got the very some nice pitcure card today from GCI but clearly MBNA from the phone number. Like yours mine said they would call week commencing 13th July. A bit pointless telling me this at the end of the week!
