Hi I was a full time employee with my firm for nearly 5 years and was told in December I could take redundancy or take a part time job starting January 2009, in a different department. I have what i think is called a rolling contract, so it states i have worked continuously - but now in a different department. I was told that if i applied for the job i would be looked upon favourably. I took the job.

I have now been told that I am in a pool for redundancy again. If I were to keep my job though the whole firm have been told there will be a 20% drop in hours and equally 20% drop in salary. As I am only part time anyway this would impact on my take home salary so much that it would not be worth my while.

I have said i would like to be considered for redundancy but have not yet attended the meeting, this is happening on Monday.

 

My questions are as follows:

Will I get redundancy at my old salary or my new part-time salary? I worked for 4 years 10 months as a full time employee and since January 2009 part time, with a continuous contract.

If I offer to take redundancy will that affect my pay?

Any advice would be greatly appreciated as I feel they have saved money by offering me a part time job, at a third of the pay, and now want to lay me off at a lower salary, thus saving them money?

well if they do lay you off, you can ask them for written proof of when they knew it was going to happen or when they made that decision. if you get that in writing, and it was before you went to part time, then you might have a claim, but they would probably say they knew it was going to happen after you changed, but at least you would have it in writing, and if you find out differently later, sue em.
