Thanks Jonni, to change the POC, I will also include my list of charges, correct?

 

When do i apply for the removal of the stay, now and then change POC or do the POC first and then apply for the stay to be removed.

 

I have until the 22/11 -

So do the n244 form, do the removal of stay letter and write covering letter to explain once changes are made please accept letter for removal of stay?!

I going to send a application for removal of stay. In it it mentioned an attached list of cases that have been settled out of court. Where is this attachment? I have seen it somewhere but cannot locate it.

I was thinking of sending this letter to the solicitors first:-

 

Dear Sirs

I write again in connection with my claim against your clients Lloyds TSB with regards to the refunding of unlawful charges that have been applied to my account.

My previous letter to yourselves failed to initiate a response..

As you should be aware, a county court claim was initiated on the 7th August 2006 for the sum of £865.00 plus interest and costs. I have enclosed an up-to-date schedule of charges, although your clients will have several copies of these.

Your client’s failure to repay this money without the need of the courts service has resulted in the amount being owed now totalling £1,032.52, and growing by 0.19pence per day. You should also be aware that my case against your clients has been stayed to allow for a test case, but also to allow time for us to negotiate a settlement without a hearing.

With this is mind, I am now offering the chance for your clients to re-consider their position with this case.

PLEASE NOTE: - The amount to be repaid is un-negotiable and there must be no conditions attached to the repayment of what is rightfully and legally mine.

If by the 1st December 2006, I have not heard from you or your clients, then I will write to the courts and apply to have the stay removed on the grounds that my attempts to settle out of court have been declined.

Good letter.

 

A couple of points - Send a copy to the court to include in your file, and also don't hang around for a response from SC&M, you almost certainly won't get one. If I were you I'd apply for the stay's removal ASAP. I'll find the list of cases and get back to you.

HAHA HA HA - Got home yesterday lunch time with the letter in the car to send on the way back to the office, and guess what!?

 

FULL SETTLEMENT LETTER ON MY DOOR MAT!!!! :D :D :D :D

 

Never needed to send the letter! Obviously crossed out the conditions, and sent a covering note, thanking them, but also advising them that the additional charges that have been taken since this action started, I will also want them back. They will decline that, so round 2 coming up afer Christmas me thinks!

 

Just goes to show, some mistakes are noted, but not all!:rolleyes:

18/10/06 after "strained communications"and how !

verbal offer of full settlement with conditions

communications rejecting conditions from me

5/11/06 received letter offering settlement with conditions

7/11/06 sent fax rejecting conditions etc

14/11/06 unconditional settlement in bank and how !;)

Still waiting for the money. Rang SCM today, got really pi*sed off. They told me they only recieved my letter accepting the settlement yesterday, sen spec delivery, delivered Thurs 16/11/06. Gonna take another 5-7days for money to hit my account. Far from happy! :( :mad
