      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

i've just called the mercantile court London, to see why I haven't heard anything, only to be told ( by a very nice lady) that they have a backlog in paper work - about 2 weeks worth.

 

This is is probably why I haven't heard anything directly from the Merantile court..Also something about all their cases are being transferred to the high Court !! which is why there is a back log. - very confusing

 

Wanted to know if all those being sent to Mercantile could join together agianst Barclays, but was told to wait for my letter from the court !!

 

Apparently I should get written confirm from the London Mercantile soon, if I have not heard by next friday I should call her again.

 

I'm none the wiser and feel like I'm in limbo - wrote to my MP, OFT, FSA, Lambeth and London Mercantile court at the beginning of the week and have not heard from anyone including Barclays.

 

Maybe no news is good news..............

All confusing as you say.......we have (fortunately) got quite a few details now from the other MC claimants cases so hopefully we can get some overall picture soon as to whats happening.

Just rang Mercantile Court & spoke to Dan Pope at listings, looks like we can all go together on Monday :o . Yes Monday 2nd October for 10am.

 

Basically I said that I know there are a few of us in the system & would it not be easier to be heard together. Mr Pope spoke to the Manager, Angela Hodgson & we've been givn the go ahead.

Incidentally, Mr Pope told me that His Honor Judge Mackie is up to date with everything.

How are you fixed, ready to rock & roll. I need to email the Mercantile with your case or Folio number asap.

Was just thinking about posting to see if there was any developments. Well done!

Will give the court a ring now and try and speak to the relevant people you mentioned as i still haven't heard from the court itself (only Lambeth transferring me there) regarding a folio number...

I have my initial claim number (is that the same thing as a the folio number?) from MCOL/Lambeth if that's what you mean. Apart from that - ready to rock and roll.

Will PM you shortly once i've spoken to them.

The Central London County Court houses the London mercantile list. (the court)

 

The reason somone is mentioning the High Court is because the Mercantile Courts function as specialist lists within the Queen’s Bench Division of the High Court.

That's why their decisions are binding on the County Courts.

So as far as you know, what's going to happen on Monday? A case magagement conference I know but has anyone been given any guidance as to what the conference will consist of? What documantation have you been asked to take, if any?

I got a letter this morning from HM courts telling me that the Mercantile Court is moving to the High Court on the Strand.

 

I still have no date for mine. Crapping it now a bit

This could be interesting. But it is "only" a case management conference isn't it, no "trial" as such will take place?

I've sorted out all correspondence, put them into date order,as per Bookworms' instructions :D , gathered everything in her list:D & statements, well just the highlighted printoffs that Barclays sent me. And I've put in all in a nice new folder :p .

If you have done the Bookworm Bundle then this will suffice, i am sure BF will confirm, but if monday go's ahead then it will be the very first steps, but none the less very important ones.
