My personal view is that you shouldn't try to reclaim the laon repayments on a legitimate loan just because of a technical mistake, and I think a court would agree - it would be unjust enrichment.

 

Claiming back mis-sold PPI is a different matter as you should never have been enticed to pay it in the first place, as it is just them profiteering.

 

Similarly, using a defective CCA to settle a loan agrement, particularly where you have more than paid off the capital, and even more particularly if you are being harassed by the creditor, is also a different matter.

ok have got a date of late october for hearing regarding n244 application for non compliance of part 18 request and also have a court date for thr case to be heard in november. Maybe they will come up with something shortly. What do you think steve

Frustrating when no one replies I know. If you really need a reply quickly try the red triangle to alert the site team. Shouldn't be used too often but has always worked for me.

Did they settle or did you go to court?

HSBC - Pre Lim sent 12-12-06, LBA sent 27-12-06, reissued 5-1-07. Part offer rejected 17-1-07, MCOL 19-1-07, AQ - 21-2-07. Settled

Nationwide - S.A.R. sent 13-12-06, Pre lim sent 5-1-07, LBA sent 19-1-07, MCOL 2-2-07, WON 22-2-07.

Capital One - S.A.R. sent 13-12-06, Pre lim sent 17-1-07, LBA sent. Settled

MBNA - S.A.R. sent 13-12-06, Offer rejected 19-1-07, Pre Lim 19-1-07, LBA sent, Setteled 21-2-07.

MBNA Loan PPI - Pre lim sent 19-2-10, Settled.

MBNA CC PPI - Pre lim sent 19-2-10, WON 2-7-10.

HSBC PPI - Pre lim sent 19-2-10, with Court

EGG PPI - Pre lim sent 19-2-10, FOS upheld 3-7-10

It would be helpful to others if you could let them know exactly what happened.. you say they settled out of court. Was this at the very last moment ?

no it wasnt at the last moment, but i put them in a corner which they couldnt get out of. I dont want to say to much as i am waiting on next to give there defence and hopefully i will do the same with them.

when i have done that i will tell you all what i have done.
