    • Today as the registered keeper of the vehicle photographed, I received a Parking Charge Notice, for a private land car park. I have looked at streetview and I dont think the signs are noticable, they were not placed on entry to the parking area, but on lamposts around the plot. It's not ANPR monitored but must've had someone on foot as they had photo of the vehicle parked in a bay. Is this one worth contesting or will it have to be paid?   1 Date of the infringement 28/5/24   2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 4/6/24   [scan up BOTH SIDES as ONE PDF- follow the upload guide] please LEAVE IN LOCATION AND ALL DATES/TIMES/£'s   3 Date received 10/6/24   4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?] Yes   5 Is there any photographic evidence of the event? Yes   6 Have you appealed? [Y/N?] post up your appeal] No   Have you had a response? It doesnt seem to. It states they operate in accordance with the International Parking Community's Code of Practice (IPC). On the back it says "Contesting this parking Charge" and under this heading it states that "all letters contesting a parking charge are carefully considered and replied to within 28 days. Charges are put on hold until an appeals decision has been reached. If we reject the appeal, you will be provided with the contact details of the Independent Appeals Service."   There are two official bodies, the BPA and the IAS.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have recently viewed my credit file with Experian via their 30 day free trial thingy.

 

I have noticed under what i owe there seems to be a lot missing?

The section lists my catalogues, (1 missing, however they admitted to to CCA so eliminated the debt i believe) phone, basic cash account, 2 credit cards.

 

When in fact i have more credit cards, other outstanding overdraft accounts, some silly payday type loans, a laptopn under a loan agreement, and a Natwets loan.

 

So why are they not listed? Confused.... I am on a DMP and have been for the best part of this year. I am applying for BR in New Year and i was trying to establish the exact figures of what i owe.

 

Any ideas?....................

I've had the same thing over the years, credit cards, loans ect not on my file. I'm not sure why not, I'm sure someone might tell us :)

 

Remember there are at least three, CRA's, have you checked them all ?

no havent, bit concerned i even have reading on here.... about them CRA selling info to DCA's. And i put my mobile number in. Can you change your details once you have registered your free trial?? E.g old mobile number diff/old address so it looks like you have moved etc????

the debts on this credit report are ones actually at this address. Accept for mbna and cone which are still listed at old address, although i'm on a DMP and they have my correct address. However nothing attached to my mums address where most credit was obtained as i lived there on and off all my life.

 

There must be a way of defeating their system, a derilict house lol!

Years ago a mate of mine said he had a great idea to get a free Bullworker, one of those things for giving you bigger muscles :eek:

 

He said all you had to do was give the company sending the Bullworker a false address, then they won't be able to chase you for the debt :rolleyes:

 

Think he'd have a hard job getting his Bullworker too :D

Hi geministar, you are correct that all 3 CRA's have tracing products that they make available to DCA's or just about anyone who has an account with them. They can and do trace trace things like:

 

people who have moved, changed phone numbers, check if they are still at the address even if they claim not to be, check electoral reg and land registery, whether they are deceased and ofc credit applications etc.

 

Apparantly if a dca checks for a person and gets no info from the cra then they can automatically keep checking for as long as it takes and when something does popup then its reported to the dca(or whoever checked) straight away.:shock:

There is loads missing from mine too. Despite having 2 CCJs, and including all my info correctly, they are only showing 1 CCJ. Also, ALL my credit agreements except my bank account don't show up. Silly service, will defo be cancelling.

To cancel your membership to creditexpert your should:

 

"If you would still like to cancel your Credit Expert membership you can do so by contacting our team on free phone 0800 656 9000 and selecting option 4."

 

You can remove/change your mobile number on the page "Update my Details" after you log in!

Wait now for all the letters from their DCA friends, welcoming you to pay for even more debt you 'forgot' about....

 

I once suscribed to creditexpert and regularly get copies of my credit files and I have never once been contacted by any DCA! This is despite have lots of creditors that have gone off the radar!
