Hi there folks,

 

received my SAR bundel from Cap1 and got started on the "scedule of claim for charges"

 

My query is this: In coloumn G (Interest Charged) you enter the interest %.. however I am having difficulty in doing so, as in i cannot work out the amount to enter.

 

On previous claims I used Mindzai's Spreadsheet (CompoundSheet_v1.9.xls) but cannot get any links to work for this one. Can anyone help me with this? :confused:

***UPDATE***

 

Prelim to Cap1 - 17/12/2008

Requesting £1410.82 (£632 Charges and £778.82 Compound Interest)

 

Reply from Cap1 - 19/12/2008 ( .oO that was swift!)

Offer £155 (the difference between the older charges and the current £12 charge) and a further £10 to acknowledge the interest i may have incurred.

 

Time for a rejection of offer and LBA :D

Right, I sent my Rejection of Offer letter and LBA in one go and received this responce...

I think I should be filing a claim with the court now (please correct me if wrong!) yet would like to know the exact steps I should take at this stage as all other claims have been coughed up before this stage.

hi mt,

dont worry not all claims are sorted that quickly.

 

i would send them another final demand for all the penalty charges plus interest allowing them 7 days to settle.

 

if you dont get any response start court action , the poc is in the stickys above.

 

send 2 copies to the court and keep a copy for yourself.

 

cap 1 will make you another offer and they will say they are going to defend.

 

good luck and keep us informed.

 

make sure on the poc is clearly marked "credit card charges" as i have had a case stayed at worcester, the judge thought it was bank charges.

Hi there, I sent Cap1 yet another final Demand and was fobbed off with the exact same responce as previously.

 

Now a question with regard to the POC N1 Form...

 

In the "Value" section how do I work out the Daily Rate?

 

NO WORRIES I WORKED IT OUT... THE ANSWER LIES ON THE FORM :roll:

Getting excited now!

Have completed the N1 claim form... 3 copies

- 1 for me and 2 to submit to the court office.

 

I have also attached the POC for Cap1 from >>>HERE

 

Also attatched my Schedule of charges onto the POC

 

Just waiting for the jobcentre to send me a confrimation certificate that I am on JSA through redundancy to attatch to my EX160 remission form :)

 

Soon as that comes through I'll make sure the amounts are correct (dependant on date) and take them to the Court

 

Let me know if I have missed anything! :-?

 

Will keep you all up-to-date with what as and when it happens :)

Wow it actually took a month for the DWP to send me the information i needed to supply alongside my claim!

 

Anyway the court has now filed this claim and deems it effective from the 6th June 2009... just gotta wait and see what they say within 14 days :D

Good luck.. Theyre usually quick to acknowledge service, its just the courts are slow to get that info out to you :-(

Not entirely no, quite a difference in what I calculated, even the Section 69 8% figure they give is not right in accordance with the Spreadsheet I used from here.

 

I can't actually see how they came to that figure at all lol.

 

Just wondered though in a case like this anyone else who has delt with Capital One if it is a case of "grab with both hands and run for the hills" or "dig in your heels and fight them all the way" ??? :confused:

I didint read your previous posts :oops:. Hopefully I will hear from them in the next few days, I could really do with the money at the moment.
