Bank of Scotland terminated without default notice and without claiming full balance, Blair, Oliver Scott DCA

Hi - received response to my SAR - only covers up until November - DN was dated 10th November (received 28th November) gave me until 24th November - no days allowed for service. There is a note on the recoveries file "NOD" (Notice of default?) 10/11/08 and the same note for the 11th. Doesn't cover the termination as the notes only cover up to November. Will be writing asking for December.

I think that them saying terminating agreement means they have withdrawn facility is a load of rubbish - if they wanted to do that they could have just not renewed the card????

ive got lots of holidays this month and this will help me to read all the success stories here and keep upto date with everyone each day

Thank you Cleo:), as i thought SOMEONE has either a] manually entered the NOD [but unable to put anything as sent as the computer generates the letter or as I suspected on ALL other letters as it says CORRESPONDENCE ADDRESS, but NOT under his one shows the COMPUTER DID NOT generate which goes in line with the letter dated 6th september with NO mention of a DN previously issued.

 

On yours it is well known they hold back the letters.

 

Ha totally screwed themselves!!

Yep and they keep digging even bigger holes for themselves with a mystery repeat 'statement' that turned up yesterday. A bit of cutting of certain text from the original that I have;) mmmmmmmmmmmm........

Now that we have got SAR stuff can we try to recalim charges if account is in dispute??? I read on here that if you are not paying, to try and claim charges back could be "false enrichment"?

looks like it is on "automatic dial" as ther is half an hour between each call!! I have not had many since I sent harrassment letter

are these automatic dial calls silent calls? I believe OFCOM, etc, take these more seriously as harrassment. Keep logging and then report them.

B****r that! If they have an agreement then the charges are an unlawful penalty. If they don't have an agreement/it's unenforceable then they shouldn't have added charges or interest, so they're getting away lightly if you only go for charges!

 

Technically, if they don't have an agreement then they've just given you a gift of the money because they want to, as there has never been anything signed to say you'll pay them back. Not an argument I'd be willing to try in court (although I think some are:eek:), but technically true nonetheless!

 

That's just my opinion though, and remember I have lost all morals that I did have a few months ago after being on the receiving end of the rubbish all these companies have thrown out.
