HI.

 

I applied to have my deposit returned from the Deposit Protection scheme And I have now 14 days to return a statutory decleration notice for tennant form that was sent to me by the DPS.

 

Is there any way I can get back this deposit?

 

I faced ilegel eviction from my previous landlord in form of a text at 11pm at night. And I am now living in an alternative rented home.

 

Could any one help?

lol wel mi got no lawful reason at the mo apart from its my darn deposit and the landlord can keep his hands offa my dosh lol

Start at the beginning.

 

Why does the landlord want to keep the deposit, and what is your reasoning behind thinking he is wrong?

Ex-Landlord wants to take the deposit cus i owe him about a grand and a bit for rent.

 

I aplied to the schmene for my money back and the landlord refused because i owe him money.

 

But not to sure what to do becuase the DPS have now sent me this notice saying ive 14 days to return the form or they will return the landlord the money.

OK then your argument would be that the deposit was held for damages not rent - so put this on the form and send it back.

 

However - I'm inclined to think that the landlord will have the deposit returned in any event.....but thats the only argument you can use.

sometimes when you are sorting youre own stuff out its ahrd to think what would I say to someone else.

Can't see you getting anything though i'm afraid because even though the deposit is not 'intentionally' held for rent arrears I think in this case you're not going to get anything.

 

Personally I'd be doing the same as the LL PLUS I'd be suing you for every penny of arrears also.

The only thing it would depend on is whether the AST states that the deposit is held for damages only....
