payday loan/clarity dca/ now settled, qestions

three years ago, like a mug i got one of these loans,

the loan, to be paid back by direct debit, was called three days early.

in there wisdom, the payday company charged me £70 for there mistake.

i refused to pay and in the end was sent to clarity dca.

i told clarity to take me to court, i had no objection in paying back the original ammount, but refused this penalty charge.

 

clarity have now relented and i have paid back the original ammount, i used a pre pay credit card to be on the safe side.

i received an email from them stating on receipt it would be full and final.

 

now the crunch of the matter

 

this debt has never been on my credit file, no mention of the payday loan company or clarity, no default notice received.

 

i take it now the account has been paid in full, clarity can not now put any thing on my cra file in relation to this account as there is no debt

This is very strictly against the DD rules - they are supposed to give you 14 days notice if the date and/or the amount changes.

 

It's probably too late now but make a mental note for the future that you should complain to APACS - APACS - the UK Payments Association. I have done this three times and had surprisingly satisfactory results (one of them was RBS and that gave me enormous pleasure :-)).

I really do appreciate all those 'thank you' emails - I'm glad I've been able to help. Apologies if I haven't acknowledged all of them.
