Hi everyone

 

Just been to check my online account with Natwest and the £10 cheque I sent has been cashed on 6 July. I sent the request for information on 20 June. That means that 40 days are up on Monday 31 July IF I count weekends? (I'm going to do a search now and find out if that is the case or not so please don't tell me off;) ). I am going to ring Bishopsgate tomorrow to ask how soon I will get the 6 years information I requested. There's a lot of motiving stuff on this forum.:)

Hello received my statements. Didn't have to phone. They owe me £898 approx at first look. Need to find out what a paid referral is first amongst other things. Will keep you posted. Still not smoking.

A paid referral fee is when a DD/SO/cheque is paid that take you over an agreed overdraft. £30 an item(max charge £90 per charging period). Hope that clarifies it

Can I just clarify generally - is a charge of £14 each month for servicing my overdraft and therefore not reclaimable or is it for unauthorised overdraft charges which is chargeable? How can I tell? Its a NatWest account.

 

it looks like this on my statement:

 

Charges 30May A/C ********* 14.00

 

I don't want to send prelim let with schedule of charges which aren't correct.

I'm reclaiming it. 2 reasons. There are no costs in administering your overdraft and if it wasn't for the other charges you probably wouldn't have an overdraft to administer in the first place.

 

Include it anyway - it's far easier to withdraw that part of your claim than try and add it on later but my guess is they won't argue.

Hi

 

Have got reply from S Higley. Have printed LBA off ready to go but if I start 14 days from 2 August that will be up around the time I go on holiday on 18th for 1 week. Shall I hold fire and send LBA just before I go instead? And no-one replied to my query re what constitutes 14 days - does it include weekends???????

Send it straight away... they will reply to you very quickly... its a bog standard... p*** off letter... so then you should be able to go straight to money claim and start that ball rolling as soon as you get your letter from Mr. Higgly

Eejit. That's technical-speak for 'perhaps you didn't think this through very well'. Of course, the insurance MIGHT be of some use to you, but in my opinion it's best avoided - there is sure to be a loophole for them to wriggle through rather than pay you out.

The answer is NO and you can cancel it. Insurance on CC is only good if you pay off the whole balance. You can cancel it without any problem because it does add to what you have to pay. Once you have the card and balance transfer complete get rid of it

Time for me to file court claim is Thur 17 Aug (the day before I go on holiday). Is there a concensus as to what is best - the paper way or the moneyclaim way?

Have had reply to my LBA. The usual blah until the last but one para when he says "Incidentally, I see that our (I think he means your) letter suggests that we have been acting as your fiduciary. I am unsure of the basis for your contention, as this does not form part of the normal banker/customer relationship.

Well, from that it sounds like there shouldn't be a fiduciary relationship between a bank and a customer. Nobody is claiming that the banks aren't meant to be making a profit from the customers (they're not a charity), the claim is that the charges are punative rather than to cover the true costs of our breaches of contract and are therefore unfair in contract law?

 

mods - what is the basis of the fiduciary statement in the library letters? Higley seems to take real offense when it is suggested.

I'm just trying to complete moneyclaim and trying to work out the 8% interest. What dates do I use for this and do I work it out from the total amount of claim? . Is it 8% from the time I issue the claim until they pay or from the date of the first charge? Is it in the FAQs cos I can't see it.
