  1. too late have banked it. What shall I do. just file the discontinuance form they sent OR write and say thanks for part payment but you still owe me costs and interests so lets go to court???

  3. just keep following the steps and you'll be fine. I received my cheque on Saturday. Its a bit scarey sometimes but come on here and people will reassure/advise you. J.

  7. Hi there did you get a reply to your query. My bank has just settled with a cheque for the basic amount but have not included court costs and not sure whether to bank the cheque or not. Look forwarding to hearing from you. Regards
  8. Have received offer for £750 and accepted as part payment only.
  9. Sit tight. Don't panic. Before I'd even returned the AQ I got an offer of approx half of what they owe me in almost the next post which I have today said I'd accept as a part payment. You should hear something positive soon ie a "goodwill" offer. Depending on you and the amount, you can accept in part payment but continue with court proceedings to recover the full amount. Keep us posted.
  10. have just sent off AQ to Shoreditch and Clerkenwell court with £100 cheque together with copies of schedule of charges and copy letters receive so far from bank together with a covering letter saying look forward to receiving date for hearing copied to Cobbetts Cobbetts wrote this week protesting at my reply accusing them of intimidation by requestion Part 18 particulars (using the template provided here). I ignored them. Keeping fingers crossed that all will be ok and cheque will arrive in my account v soon.

  14. thanks - defence and request for further info received today. Am going to send the usual let saying this is intimidatory and I don't have to do it anyway with a note of my account no etc and schedule of charges. Do I now wait for allocation questionnaire from the court??

  17. I now assume that 28 days from issue of claim does not include weekends/bank holidays? If so I am expecting a defence to be filed on Friday 13 October.:o
  18. I am also at the same stage. Filed MCOL, and waiting for 28 days to be up which should be about 3/4 October. I'm expecting a defence part cp18 request etc etc then.The only way I know that an acknowledgment has been filed is by logging onto MCOL website! Keep in touch. Jacqui

  21. I would definitely send LBA and follow the steps. This way you won't be caught out on a technicality such as not giving notice of court action which is what an LBA is. Good luck.
