You could get nasty and send them a version of the below (you know the local area so change what needs to be changed). Unfortunately the people who are replying are having to comply with the company policy which is being foisted on them - which is not to cancel tickets. But you might as well send the mail and try.   Dear Cissy, thank you for today's mail. Of course you are "able" to cancel the charge, you simply contact Excel and tell them to cancel the charge. I will wait for exactly 24 hours and then contact the local newspaper XXXXX and the local radio station XXXXX about Iceland's disgraceful disability discrimination.  Nothing much happens in Gravesend so I'm sure both will be happy to do a piece which will generate terrible publicity for your store and drive away customers, which is exactly what you deserve.     • You are absolutely right to be cautious. It would be helpful if you will be prepared to send me a private message containing details of the outlet and the address et cetera. It might help me to get things more into perspective. So I understand that you had a business selling your husband's photographs. You were unable to continue your direct involvement and so you made an arrangement with a manager who you trusted to carry on the business for you while you were recovering elsewhere in the country. Is this correct? This manager has possession of all the files of your husband's photographs. Is this correct? Do you have any copies of the files? You made a reference to having a Co-op. Does that mean that you are running a Co-op supermarket or groceries outlet? I don't quite understand here. In terms of the possibility of continuing the arrangement with this manager – my own view is that you need to bring the arrangement to an end and I don't see how you could trust them. As far as I can see you are asking about two issues. Making sure that the files in the manager's position are destroyed so that you regain control of the photographs. Obtaining some damages for the loss of revenue. How many photographs do you believe are in his possession? What you estimate is your loss of revenue so far – probably calculated on your average revenue over, say, the five years before you stop your involvement in the business? You are talking here not only about a breach of contract. You are talking also about breach of copyright and frankly you're also talking about theft. Additionally, if you begin the dispute with this person, I would say that they will probably leave immediately. Have you got somebody else to run the business or would that be the moment that the whole thing collapses? If it is the latter, then this is something else that you need to prepare – somebody to take over as seamlessly as possible   Also, do you know the address of this person – and do they own their own home or any other assets?  
    • Just as i thought (from above post) : i just hope this is not the normal customer service that say they cant do anything and that you have to appeal to excel parking 🙄 this is the response my friend has received today - totally ignoring the subject which was: 'victim of disability discrimination on the part of your agents' does anyone have any ideas to reply with please?     Thank you for your response.   I would like to apologise for the error in the previous email; our CEO, Tarsem Dhaliwal had received your email and tasked ourselves in the Executive Resolution Team with looking into this.   We have raised this with our internal property department who have more information on parking charges and any appeals, we can see that you had appealed the PCN with excel which was rejected, you then appealed the PCN with IAS which was also rejected.   Because of this, we would not be able to cancel or refund the charge.    I understand this may not be the outcome you had hoped for, I am sorry for any inconvenience caused.   Kind regards, Cissy

    • I appreciate any help on this. I got 2 different speeding tickets and I'm hoping I can get one of them canceled as it's for the exact same road, 2 days back to back. The limit was 40mph, but I honestly thought it was 50mph and so I was driving withing that limit... First time driving that road. No other points ever on my driving lisence if that matters.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I had been on incapacity benefit for 8 years because of depression, I had developed other conditions in the mean time, which is bursitis of my right hip and RSI in my right hand, causing me un-able to use the full function of my leg and I went to a medical in February. Failed the assessment as I feel I did not get a fair assessment and everything was put down differently. It was claimed by the medical examiner that I could stand in the shower for 45 minutes among other things, which is no way true and because of my depression I have no take on time or how long I am in the shower, but because I have to use a chair when in the shower standing in the shower for as long as stated would be impossible.

 

I decided to appeal against this decision, which put me onto reduced rate income support while I was appealing. After four months of waiting I finally got an appeal date. I went to the appeal and even made sure they knew how it was for me, however they dug holes everywhere in anything I had said and made it very hard for me to answer anything correctly, they put me in a position where I would only clam up and find it difficult to get anything I wanted to say out. They asked me stuff like do I know what 50 metres are; well no I don’t because I do not measure distance. They made me feel horrible and got me to a point where I was so confused that nothing was coming out right and I could not say what I wanted to. and they suggested I was lying. I found the appeal very difficult. At this point I had no chance of winning the appeal. I did not win the appeal. I now feel like I could have done more, said more or at least done something that would have won me the appeal. I have feelings of guilt as well because I just feel like I messed it up. I am not sure what to do next or where this will take me, but what I do know is that I was not lying. I told them how it was for me, but I feel they just ripped it to shreds.

I don't think i have many options left. I did go to CAB and i did see someone there, but they could not go with me and i don't think i was pepared enough. The trouble is it was so hard for me to get myself there in the first place and found it so difficult to tell them anything because of the way they treated me. I have now called Welfare Rights and have spoken to them, they have advised me to get the reasons as to why the appeal was turned down, the only way i can appeal now is if its wrong by law. The appeal panal basically did not believe a word i was saying because of the stuff that was put in the orginal report.

 

I feel so low and down now and i feel very upset that i lost this appeal. I feel like its my fault and i should have said and done more. The CAB worker did not come with me to the appeal, They ripped my submission to pieces. I am at my wits end and don't know which way to turn. I already find it hard to tell people anything i don't know, so they just made it worse for me. In some ways i wish i had never gone because i feel i have wasted four months just for me to fail all over again. I wish someone had been able to go with me because then i would have had more chance and they would not have been able to treat me the way they did. I feel like i blew the appeal myself. In some ways maybe i never got the proper help, i just don't know.

 

I am also informed by the welfare rights people that i can try to claim incapacity again for a different problem, which i probably could, as i now also suffer from a hip problem and S.A. However i don't know if i could put myself through all the pain again just to fail. JSA is another option for me and i can tell the job centre because of the problems i have i need to restrict my hours that i work, as i know i can not work full-time.

Have a question for you, which needs clarifying:

Are we talking about IB - which does NOT rely on mobility as implied by your comment above eg ability to walk 50 metres being the lowest distance detailed on a DLA form for exaxmple, there are no questions on any IB50 for how far you can walk - or DLA here? If so, they really shouldn't have been asking such questions of you. Maybe it is the appeal tribunal/panel ... who are fault. As it seems they are asking questions not pertinent to IB.

Erm, your own GP cannot overturn any decision made by the DWP as your GP has no direct access/involvement in the process. All your GP does is provide any evidence when requested by the DWP. So, it's hard to see how your friends GP managed this.

 

I think a lot of questions need to be asked here ...

 

What I think you need to do - just me, though - is visit your local advocacy centre. They should be well equipped, well acquinted with all this and will, in some instances, act on your behalf eg speak for you. Unfortunately, although CAB is often the first option for many ... you will need someone who is very knowledgeable about benefits in the first instance.

 

No disrepect, but you need professional help with this eg through an advocacy services, who may also point you into other directions who can help ... but whatever your friend has said about his/her own GP 'overturning' the DWP decision ... unless they mean they contributed some evidence which did ... is incorrect. That is not how the benefits system works I am afraid.

You need to get proper advice about your situation now- are you receiving any benefits?

 

I still think you should talk to Welfare Rights, get application forms for Incapacity Benefit, Income Support and Disability Living Allowance, go and see your Welfare Rights Officer and get help filling them all in.

 

I don't think there is a magic wand which will turn back the clock and maje everything okay. But you can get help for now- if you ask for help from welfare rights.

I have just filled out an assessment form for IB (NOT DLA) and that was full of questions about how far i can walk, what i can carry etc. I dread to think waht the outcome will be, but whether they pay me or not, i still cant work.

I would never fill out these forma with out the help of a welfare rights advisor- they translate my "normal english" into DWP-speak. That is what makes the difference form me.
