    • I received several letters from J&P which were just ignored, but now I've received the same paploc Eve appears to have. As it stands, I'm looking to complete & reply as per the oft-referenced thread #5. After reading a few comments about ignoring and nothing progressing from J&P side, I'm intrigued whether they were just general 'please contact us type letters' or letters of claim/paplocs?  I realise for some it's a personal decision or based on advice, but given advice on here is not to ignore paplocs, what was the reasoning to ignore? 
    • Afternoon All. I have today received a court order requiring me to send them more details before 16:00 on 8 July. A copy of the order is attached, but the relevant paras seem to be: 2 Send all of the documents that are relevant to your case to the court at the above address, also send them to the other side. Both parties must do this. These documents should be placed in date order and should be numbered in the bottom right hand corner. You should include the following documents if available: •       A copy of the contract/agreement •       Relevant correspondence, including text messages and emails  Photographs Before 4pm 08 July 2024 3 Send to the court and send to the other party your own witness statement and also witness statements from anyone who can give relevant evidence about your case. Both parties must do this. A witness statement must •       have the court case number at the top •       start with the witness’ name and address •       it must contain numbered paragraphs and should be typed and double spaced. If not typed, it must be written clearly in block capitals or printed. •       finish with the words “I believe the facts set out above to be true. I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth”, the date of the statement and the person’s signature. The original statement must be sent to the court and copies must be sent to the other side. Before 4pm 08 July 2024 I'm a little confused by para 7 in the order : Because this order has been made by a Legal Adviser without a hearing, you have the right to request that the decision of the Legal Adviser be reconsidered by a District Judge. Any request must be sent to the court to arrive by 4PM 12 June 2024. The request may be made in your online account, by email or on paper. The request must include an explanation of why the reconsideration is sought. Is this normal? Do I have to do anything with this by 12 June?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Removal service made an illegal charge to my bank account and lost some of my things

I recently moved and had two problems:

- the removers lost some of my belongings.

- I had paid the full costs before the removal but the removers made an unauthorized charge to my bank account on the day of the move to pay for extra staff. This happened even though I told them I would not pay this charge.

 

Can anyone who has been in a similar situation advise me?

Can you confirm that the charge to my bank account was illegal since I didn't authorize it?

yes check with bank and get it repaid, unauthroised. then put your complaint about lost bits in writting to firm, with description, value, where it was packed and how. and what are they going to do about it, replace, refund value etc. Ask to be put in touch with their insurers as you want to claim, that usualy gets a response.

Well the bank says there is nothing they can do because I gave my account details to the company, thereby authorizing them to debit my account! Let's hope they don't feel like debiting a grand tomorrow!!

 

The only reason I put it on Maestro and not a credit card is that the removal company charged a substantial extra fee.

That is cannot be true, as you say whats to stop them taking another £500 tomorrow. Go back to bank and ask them how you can protect yourself from this fraudulent practice. Scary, how many times has anybody paid for stuff by card over the phone or on line. I have challenged withdrawerals on my card before and got them reinstated.

Complain in writing to the bank saying it was a fraudulent transaction and you demand it being refunded as the company had originally told you there would be no further charges, therefore the fact that they kept your card information was fraudulent. Give them 8 weeks for the 'deadlock' letter or refund.

 

If you don't receive anything within 8 weeks or receive a deadlock or unsatisfactory response, complain to the Financial Ombudsman Service - Financial Ombudsman Service.

 

Regarding the items lost, write a letter to the moving company detailing what they lost and the values, demanding it to be reimbursed, otherwise you will issue proceedings.

 

Send all letters by special delivery, not recorded delivery and keep the receipts.

 

I would say at first sight you made a mistake by not paying for the service on a credit card, as if you had you could claim under s75, CCA 1974 for the loss of your stuff by the company as their 'service' would have been covered by your credit card provider.

raydetinu, I've moved abroad so I suspect they think I'm going to give up because of the inconvenience involved in making a complaint from overseas. I have kept emails exchanged with the company where I specifically stated I did not agree to the extra charge. The move cost around £2500 and now they want to take an extra £200 on top of that!

 

I find this whole business of them being able to withdraw money from my current account very fishy. They certainly didn't have my signature or PIN.

 

legalpickle, you are absolutely right. Basically I'm in the process of paying off a large CC balance so I've avoided using the CCs lately. This is one instance where I should definitely have used a CC. I'll know better in the future.

update:

 

1 - the bank maintain there is nothing they can do.

 

2 - I've submitted an insurance claim for the missing/damaged stuff

 

3 - the movers quoted this in my contract:

"we may change the price or make additional charges if circumstances are found to apply which have not been taken into account when preparing our quotation and confirmed by us in writing. These include:

...cut blurb...

The stairs, lifts or doorways are inadequate for free movement of the goods without mechanical equipment or structural alteration

...cut blurb...

In any such circumstances, adjusted charges may apply and become payable"

 

Basically they won't refund me because they had to take the base off a bookcase and feet off my sofa to get them up the stairs.

 

So depending on how much I get from the insurance, I may be both out of pocket and out of items...

A charge cannot be debited from an account - lawfully - unless there is advance notice of that charge.

 

They basically therefore stole the money from your account. They must send you an invoice explaining what that covers.

 

It is an unreasonable term of contract to charge somebody after the event without agreeing it with them.

 

As this was therefore taken unlawfully out of your account, the bank is obligated to deal with refunding it.

 

£200 is hardly worth it for taking the base of a bookcase and feet off a sofa. If you were in Greater Manchester or London, I could have had those two jobs done for you for £30!

 

I know you're overseas, but I would sue 'em through MCOL using an address of a relative in the UK.

Thanks, legalpickle. Is there a template letter on this site I could use to contact the bank again? I mean like a short paragraph that states it was illegal to debit this money.

 

Not that I'm aware of. If you draft something I'm happy to proof it for you.
