    • I left Dubai 8 years ago and intended to return. However a job prospect fell through. I’d been there for 15 years. Anyway I decided to pay my credit card and the bank had frozen my account. There is no means to pay the CC so completely unable to pay when I wanted to other than the bank advising me to ask a friend in the UAE to pay it on my behalf!  fast forward bank informs there is a police case against me for non payment. Years later IDR chased me and after months/ years they stopped. Now Judge & Priestley are trying their luck. Now I have received an email in English and Arabic from JP saying the bank has authorised them to collect debts. Is this the same as IDR although I didn’t receive anything like this from them. Just says they are authorised?
    • The neighbour's house is built right on the boundary so the side of their house is effectively the 'wall' in our garden separating the two properties. It's a three storey house and so the mortar poses a potential danger to us. Because of the danger, we have put up an interior fence in our garden to ensure we don't risk mortar dropping on us. That reduces the garden by 25% which is not only an inconvenience, but it's the part of the garden where we had lined up contractors to install a patio and gazebo which we will use for our wedding reception in less than 2 months. We have spoken to the neighbour's caretaker who is on the case, has spoken with a roofer and possibly a scaffolding company, but there are several issues. They don't seem to understand the urgency. As long as there is a risk of falling mortar, we can't carry out any work in the garden, and unless they hurry up, we're looking at cancelling our wedding as it's not viable to book a venue because we can't use our own garden! Also, they want to put the scaffolding up in our garden which would be ok with us if it was a matter of a few days and they hurried up, but there is a tree (most likely protected by the conservation area), so most likely they can only reach part of the roof with the scaffolding if they put it up in our garden. We suggested a roofer with a cherry picker but they seem to want to use a company they've used before. Any and all comments, suggestions, advice is more than welcome.  PS. does it make any difference that the neighbour is a business (ltd) and not a private dwelling?

    • Apologies all for the late reply and info, i have been away with the Army. They have paid I accepted the offer on the 5th of May, and they paid on the 17th of May.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

As you can tell by the title im very angry, Ive been a customer with phones 4u for a year and a half and ive paid my bills on time with direct debit, with absolutely no problem, then I received a text asking if I would like to upgrade my phone to a newer model as my contract was ending, So I rang the number up and requested a upgrade, the salesman sold me a new model and asked if I would like to keep my old number, took my bank account details and I requested to be debited on the 16th as I always have with phones 4u, So on the 9th a debit comes out for 47 pound, strange, so I ring Orange and they tell me my bill for the 16th is still getting taking out, The woman at Orange found it very strange , she mentioned for some strange reason phones 4u have created two accounts for me! So i went off it! phoned phones 4u , promised two phone calls back but nothing!, then phoned again today and it was like talking to a brick wall, he said I didnt upgrade my phone I just created a line connection! WHAT! why would I use two sim cards for one phone and pay 40 quid each tariff!!! doesnt make sense, then he says I was phoning him on my old contract but It was the number I kept on which the salesperson told me, I checked the sim afterwards and it was the new sim card they sent out and as Id said to the lad on the phone I have kept my old number!! honestly thick as ****. He asked me which way i want to resolve the problem and I said I want the other account closed you created and my money back, He turned round and said we cannot cancel the account !!!!!! smoke coming out my ears at this point. He said I have to give a months notice to cancel a account I never created!! sorry for the overuse on exclamation marks! then he turned round and said people do make mistakes! still no resolving, He reckons he will play the call back from once I upgraded and if in the conversation I wasnt asked to keep my old number and I was told it wasnt a upgrade, I wont have a leg to stand on, but if I have its my fault for being so silly and wanting to pay for two bills for a year and a half, so thats 80 quid a month at least out my pocket! how ridiculous! So im awaiting his call 48 hours he reckons, I will reply to this thread in forty eight hours. probably heard nothing.

 

Sorry for the long story but im at my wits ends and really stressed out, Is there anyone I could get advice from or action I could take,because as far as Im concerned they have abused my bank account and totally taking the **** out of a loyal customer.

 

Do Not upgrade or use Phones 4u!

I dont trust them either. Recently closed contract with them after found out they had sold me vodafone when I wanted orange, the vodafone masts had been taken down and they told me 'they' chose vodafone as an alternative as they had accepted me. Orange later told me they had not turned me down and said in their store that off the record 'maybe vodafone was giving them more of a cut on that day'in answer to my confusion. I didnt even think of approaching orange directly I just got hijacked in by this polite salesman offering me 100.00 free that day if I signed up. As I was wanting a new phone it seemed a good idea and I was offered orange as I walked in and I was orange pay as you go prior. Turned out they were aware the reception for vodafone was intermitant and I had told them all along the line needed to be very good as due to illness I needed to rely on being able to use it, not get no connection, dough!!

Any how I got my way after a long argument after vodafone backed me up in the reception being known to be intermitant and they wrote it down for me to give to phones 4u, who told me later they knew there was a problem.

Incidently as I left the store originally with the contract they told me the sign outside saying 100.00 and told verbally we'll put it in your hand was not the case and in fact it would be credited to account after been with them one month.

 

So I would never believe a word they say again personally from my experience. They blatantly missold me and promised money in cash that day that they know didnt happend that way. Their answer to this was well its marketing and I replied fair enough but you have to be marketing the truth and not poop. They had no reply to that.

 

Recently walked by the store and a man said, come on in my friend you look very smart, we can do a deal, how would you like 100.00 cash 'today' and free. The manager turned round from his chair at this point and his jaw hit the ground, yes the sign and offer was still the same and he poor man recodnised me. I dont know how they are allowed to get away with it. I walked on.:-)

 

I am sure there are some happy customers of phones 4 u and I would like to think my case to be fair is not the norm, but Ive heared some horrors of stories of them. Its obviously a case of commision based sales and get the signature.

Sorry, but you were just as culpable as they were!

 

Did you never stop to ask yourself, that if this was really the same company your had your DD with, WHY would they have needed your details over the phone again, when they had them all already? This has all the makings of a disaster, and that's what happened as you've no proof of what transpired. They company could say you legitimately requested another phone contract, how can you prove that you didn't?

 

As to the payment, the bank will not recall it as by giving out these details, you were clearly expecting the firm to take the funds required, so no recall would be permitted. Once you get into the 'they said/I said' with no paper trail to prove the agreement (and they are not required to provide you with any recordings, as that's for their protection not yours) you are often on a hiding to nothing.

 

More positively, I think you should run this past your network, explaining you ordered an upgrade and you've been sold an additional contract, if they don't help, then complain to OFCOM who are investigating these trade 'mistakes' at the moment.

Hey, I'm going through an identical problem with Phones4u right now...I'm waiting on them 'getting back to me' after they listen to the phone call. I'm pretty sure I'm not stupid enough to agree to having 2 contracts, so they either didn't make it clear or they majorly screwed up. So angry!!

 

How did your situation turn out? Get any money back?

listen to your legal script. they will advise you are now entering into a new 18/24 month contract and will be allocated a new phone number.

they don't have to- but may tell you how to cancel your old deal.

if for any reason you're 100% sure that you werent told this, call up and someone will get the call escilated and listened to. that way you can find out what you actually agreed to.

hello

 

i've finally managed to try and get this sorted. of course, phones4u "couldn't find the phone call" that was made, so i was therefore told on the phone by a phones4u salesperson that i would get no money back, no matter how hard i tried.

 

however, i wrote a detailed letter of complaint to the complaints department, including a written account of the whole situation. i was called within a few days of sending the letter, and without even having to argue, i'm getting a cheque from phones4u for £105! can't believe it!

 

so i recommend writting a firm complaint letter if you are in this situation!

That's my experience. P4U know damned well what staff are doing and will back down with a reasonable complaint. Mine was 4 pages long and listed no less than 5 breaches of contract as well as 4 unfair practices I witnessed instore.
