I have just started my claim against Nat West for PPI on a loan I took out in October 2005. (I successfully claimed back over £3000 in bank charges last year and have had nothing but hassle with this bank ever since).

 

I arranged the loan over the phone with my local branch. The guy never mentioned PPI but when I received the paperwork to sign they had added it on to the loan. I rang to query it but was basically told I could not have the loan without it. I needed the loan so signed it.

 

I recently wrote to them saying I beleive the PPI was missold and requested they cancel it immediately and requested a refund of all PPI I had paid. I only have 4 more payments so it adds up to quite a bit.

 

They have replied today and asked me to fill in a questionaire before they will look into my complaint fully. Is this just a delaying tactic? has anyone else rec'd one of these questionaires. Do I need to fill it in to proceed with the claim.

 

Any help would be appreciated.

I would say it's a delaying tactic! Like you my first claim was for bank charges and I learnt alot - the main thing was not to play their games ;)

 

My plan of attack is (and has been sucsessful)....

 

1. Hit them with a S.A.R - (Subject Access Request)

2. Get my facts together and write requesting a full refund and a response within 14 days (I ignore their questionares and 8 weeks to investigate b*llsh*t)

3. After 14 days, I send a letter before action giving them a further 7 days!

4. After 7 days, start court claim and for good measure report to FOS, FSA, OFT and Trading Standards as appropriate!

First Direct - Refund of Bank Charges...... **WON** (Offered full amount of £5200 2 days before court)

 

Amex - Refund of charges..... **WON** (£330 refunded without much fight)

 

First Plus PPI - **WON** (Full Refund of over £7000 + Interest)

Norton Finance - Owe me over £6000 for mis-sold PPI - Starting court action in the new year!

Barclaycard PPi - Ongoing (Being complete tos*ers!)

Had a response from NatWest. Basically get lost. State the policy was optional and I signed the forms to accept this.

 

Yes I signed the forms because I was told I had to have it. They say the member of staff filled out a duty of care checklist to state it was explained to me??? Just becasue they fill out a form doesn't prove it was fully explained.

 

I am going to persue a complaint through the Ombudsman and will request copies of all this documentation from Nat West.

 

My question is - In my initial letter I asked them to cancel the PPi. This is not mentioned in their response. Do they have to cancel the PPI even thought the loan has now been running for a couple of years.

You can still cancel the PPI(PLP) policy and it would be worth asking NatWest to confirm that this has been done.

the brown bold italics underlined means you can happily send your complaint to the FOS if you get nowhere with your claim and they will look at it and make an adjudication on your case. Bad news it can take 9 months.

 

the red.......A loan cannot be tied to the addition of PPI

 

the blue......They can request information from you to assist them in getting all you information, but it is not mandatory that you complete it.

 

the grey..... yes they will delay you for as long as possible.

 

the bold......yes I did filled it in to my satisfaction and terms you do not need to fill it in to proceed but it may help.

 

Have you sent a Subject Access request?

if not I would advise you to do it as this will mean them having to give you a copy of that duty of care checklist.

in the meantime write a letter send it special next day delivery (expensive but traceable) asking for an immediate cancellation of your PPI policy..

Bank charge successes:

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

Please do not PM me for advice as it may be sometime before I can respond.

 

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

I really appreciate your comments.

 

In their response they listed all the documents they had used to come to their decision which included the duty of care checklist. He said I could have copies of all these if I wish.

 

I have sent them a letter (special delivery) requesting this information as offered so that I can refer it to the ombudsman.

 

I don't care that it will take 9 months. This is my last link to Nat West and will take it as far as I can. Only got 3 more loan payments then I can close my account once and for all.

 

I have also asked that he cancel the PPI (again).

 

I await their reply.
