      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all quite new to this really but feel i shouldnt be,

 

I am about to put a claim in for an amount totalling arnd 1300 for this year made up of unplanned overdraft charges really.

This week i got a statement saying on 1st of July they are going to take out 193.13p i simply can not afford to pay that. I am a single parent for gods sake, ok i agree i should keep closer eye on finances but only in a few days now charges can exculate.

 

My rant over

 

My Question, Im sure i read somewere u can put an account in dispute until charges being claimed for is resolved. In meantime all activity on account is frozen. I have another account i can use not from same bank.

 

 

any help really really appreciated im getting down.

go and setup a coop bank account to have your money paid into.

 

if you are on benefits of anykind inform Llyods of this and show them your letters from tax credits and such. they cannot touch money that the government says you are entitled to live on.

 

get everything out of the bank before they do. me and my wife got caught this way. the banks dont care where the money comes from and what it has to pay for,. they believe they are above all other debtors in the land.

Thanks for help and i already have an account ready.

My question is tho is it possible to stop activity whilst a dispute ie bank charges is going on?. Im in recipt of tax credits etc and the charges wd finish me off nxt month for sure if i had to pay them.

you wont get them to stop they dont care about your problems.

 

so get everything moved. move all direct debits and standing orders.

 

the oft cant stop them charging you whilst a test case is on going so we really dont have to much chance.

 

i know it might be a pain moving it all but at least they will be taking there own money not your kids and yours.

Ok i have moved all direct debits etc without any problems thus far, when the charges come out of my old account (lloyds) there just going to push it further and further in the red. Overdraft interest is not going to stop is it, will they eventually get a DCA to recover the money?

SAR is definately worth doing.

 

Would also push them for Manual Intervention sheets if they dont arrive.

 

The Manual Intervention sheets can allude to whether processes carried out on your account are entire automated, or involved human action.

 

Obviously an automated process is low cost, as part of an overall IT billing system which deals with millions of entries, calculations and so forth per month will cost them a matter of pence and not the highly inflated £35+ which is being levied unlawfully against customers.

Advice offered by ENRON is without prejudice and is for your judgement as to whether to take it. You should seek the assistance or hire of a solicitor or other paid professional if in doubt.

When you receive the information, go through it and do a spreadsheet of all the unlawful penalty charges.

Next send them a letter requesting the repayment of these charges, enclosing a copy of the spread sheet. Click the following ling for letter.....
