I'm new to this site so 1st things first Hi all :-)

 

Please can you help me my wife has been having a few problems with CPW basically her contract was up about 3 months ago and she wanted to move to the new o2 tariff called simplicity (It's like a pay as you go but more suited to her needs) anyway she called them up around the 6th May and requested the cancellation and pac code so they she could take her number to o2 direct and join our friends and family staff discount offered by my cousin (an o2 employee) However the sales person on the phone talked her into taking another contract that was the same as simplicity with regards to free mins and text's but it came on an 18 month contract she didn't tell me this until last week! so I advised her to call them and cancel because if her phone broken in this period she would be stuck with a sim but no phone (both simplicity and this contract are sim only) the simplicity tariff allows you to cancel at anytime.. So my wife called the CPW and was told that the 14 days period had expired so there was nothing she could do even though the contract hadn't started (it's due to start today as she has to give them one month cancellation notice on her current contract) I looked at the T&C's on the CPW website and they state that she can cancel if she puts the request in writing within 7 days of the service/contract starting so she called them again and was told the something the 14 days start at point of sale regardless of what the website says.. Following the conversation she put the cancellation request in writing as per the website, The letter was dated 28th May but we haven't heard anything back from them and her phone is still live.. Has anyone else experienced this, is what there saying correct, have I missed the 14 days cancellation period, do I not have any cancellation rights? If I do whats the best way to proceed?

Simplicity is nothing like PAYG it is a contract and is credit checked, and has a 30 day cancellation period (after the first month). The 14 days you refer to is what CPW WEBSITE offer people who purchase the product, it is a requirement of the Distance Selling Regulations. These don;t apply to the shops, and if you completed the deal on their premises there is NO right to cancel, it remains legally binding. Sorry.
