    • Hello, Firstly, and most importantly I am sorry for your loss. I would go back to the bank with the death certificate and ask them to step in. Remind them firmly but politely that there is no limit for DD claims   Please let us know how you get on.
    • My wife is the named person to his bank account with him having Dementia being his daughter (I say named person she still is but he recently passed away and the deputyship application has now being stopped by the solicitor as it's no longer needed) We've only just got the Death Certificate so the bank will be the next step informing them. She went to the bank and explained the situation but even being his named person the bank said she didn't have the power to stop DD without any legal documents (virgin money) was the bank. She could have copies of bank statements that was about it.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

My husband was signed off from January 16th til March 28th due to surgery. He is self employed, he didn't qualify for Incapcity Benefit, could we still make a claim for any other benefit, or is it too late?

 

We thought about claiming the above at the time as we were living on my salary and it didn't quite cover the basic household bills, which is why we are now behind.

 

Does anyone know if we can still put the claim in to have some of the Council tax disallowed and back date any help towards paying our private rent?

 

Are there any other claims we could be making and if so to whom should we apply?

 

Advice is appreciated.:)

You can only claim back for 3 months worth of council tax and you need to have a good reason for not claiming. if your income is low, you may also qualify for tax credits.

 

i would suggest visiting the CAB for a benefits check.

All help is merely my opinion only - please seek legal advice if you need to as I am only qualified in SEN law.

Getting Council Tax Benefit backdated

 

You may be able to get some Council Tax Benefit for a period before you make your claim if you could have claimed earlier. Getting benefit for a period before you claim is called ‘backdating’. You can get backdated Council Tax Benefit for up to 52 weeks if you can show you have a good reason for not claiming earlier, for example, you were given wrong advice. You also have to show that you were entitled to Council Tax Benefit throughout the period of backdating – that you were responsible for paying Council Tax, and your income was low enough.

 

You will not usually get any backdated benefit just because you did not know that you could make a claim. You should explain on your claim form that you want to claim benefit from an earlier date, and give your reasons for failing to claim earlier. However, if you are 60 or over, you do not have to give any reasons and Council Tax Benefit can be backdated for up to 52 weeks automatically as long as you can show that you were entitled.

 

If you want to claim backdated Council Tax Benefit, you should consult an experienced adviser, for example, at a Citizens Advice Bureau. To search for details of your nearest CAB, including those that can give advice by email, click on nearest CAB.

Yes you can apply to have Housing and Council Tax benefit backdated for up to 52 weeks but you do have to have a really good reason as to why you did not apply at the time.

 

Unfortunately, if it was because you didnt know you were entitled to it, this would not be good enough reason as the onus is on you to find out your rights regarding any entitlements of benefit.

 

Maybe you could post up your reason as to why you didnt apply at the time and I could help you with your backdated request.

We didn't apply at the time, because we felt that in light of my income £1k per month, that we would not be eligable to actually get anything.

 

Unfortunately that was all we had to live on and our rent takes out 3/4 of that amount.
