    • Appreciate your response BankFodder. I am aware that the Consumer Rights Act does not apply in my case as I operate a business and, instead, should rely on the Supply of Goods and Services Act and Unfair Contract Terms Act 1977. I was a little unsure as, when I read the judgement of Hashim Farooq v EVRi Parcelnet, July 2023 I presumed that,  as Farooq had supplied laptops through Amazon,  the Consumer Rights Act would not apply but the judge refers to it in Section 22 as to why the claimant should be given judgment. Have I read this correctly? The reason for not offering full reimbursement was because I did not take out insurance for the full value.  In regards to correspondence from my customer,  I have emails from her in my timeline stating that she was waiting all week and that no one attempted delivery.  I have no doubt that she will be willing to corroborate the events with a written statement.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

BEEN READING THROUGH THIS SITE FOR ABOUT 4 WEEKS NOW ARMING MYSELF

SENT OFF MY SAR 20 DAYS AGO NATWEST HAVE CASHED MY CHEQUE THIS MORNING.MAYBE IT HAD SOMTHING TO DO WITH THE PHONE CALL TO THEM YESTERDAY ,JUST TO ENQUIRE IF ANYTHING HAD BEEN DONE TOWARDS MY SAR REQUEST!!:p

I was just thinking that today to call them and ask them what is going on with my SAR request, not too sure if i should e-mail them, write or phone! :!:

 

I did only send my forms off on the 7th but then i sent my barclays ones in on the 8th and i have now recieved all statements. So im hoping to chase up natwest.

HOW DO I SET OUT MY schedule of the charges ?

 

Just make a list including the date of charge, type of charge and the amount charged.

Hi, I called them yesterday after I sent off my SAR on 4th July.

 

I rang 0131 5568555 and spoke with a lady who said that my letter had been received but only just added to the system due to a back log of work ! LOL

 

Go on, pester them !

got my first letter back yesterday saying they are looking into the matter and will get back to me within the next ten working days.

they only have until a week on friday before i can send them the lba.

i can't wait:p

got the standard letter we believe our charges are fair reasonable and transparent. and we will not be refunding any of your money.

 

just made my wait to send the lba letter about a week shorter.

will be posting it first thing monday when the post office opens.:p :p

since sending my prelim and lba natwest have charged me hand over fist account charges that i have never been charged before card missuse etc

unpaid dd where as before they would just charge me referral fees.a new one has appeared today and i think this is a default charge(yet to phone at 8 to find out)but my account was in credit.and the dfault charge if that is what it is has taken me over my overdraft limit .and left me short the £30 they took was towards my gas and electric dd due to go out at the end of the week.do you think if i tell them all this they will refund this charge? if not there was another £38 charge last week.for unpaid dd

any ideas i feel like i am being victimised for challenging them.

charges are automated and the answer is they will say no to refunding. My gut feeling says cancel the DD for Gas and Electricity(you can reinstate DD within 90 days of cancellation. Speak to Gas and Electricity, explian that you can get them the money by x date and they will be fine.

thanks for the advice .

do you know what issuing a default notice will mean for my account ?

and why have they done it when for the past week i have kept my account within the agreed limit.

i'm really trying to sort stuff out i am just in the process of rejigging my finances (just waiting for paperwork to sign)so i don't go over my overdraft and they keep adding to the problem.

I'll quote from NW fees leaflet on Default Notice " if you break your agreement with us and we have cause to issue a Default Notice to you requiring yoiu to either repay the debt or remedy your breach of the agreement, we will charge £30 for our administrative costs in issuing the Default Notice."

I can't answer the why for the past week without having seen your statement over the last month. But Default Notice is one charge you can claim
