    • Yes, send a message to the purchaser but keep it very friendly and simply that you noticed that the package has now been delivered.  I suggest that you ask them if they want to keep the package still or if they would rather return it and that if they want to keep it then please will they return your payment to you to your PayPal address. Keep it as polite and friendly as possible and then we will decide what to do if he doesn't reply or refuses.  Meanwhile I will have a look at Google earth and see if you are able to spot the gas meter outside the house to get an idea if the delivery is real. Get a screenshot
    • Santander have sent their final response and have agreed that they were in the wrong. They will be refunding me the amount I am due and £50 for the delay.  Just the interest factor would be more than double the £50 that they are offering. Thinking to just close this and move on. Is this what you would do?  Opened a FOS case on the 1st of June but haven't heard back yet. 
    • It just been delivered and ive had a live chat with p2g to get some proof of deliverey and they send me a picture of the parcel placed in a gas meter box which they class as a ' 'Safe Place'  and not placed into the hands of the buyer which is either a good thing as the buyer can claim he never received It so i can claim against p2g or a bad thing . Do p2g have coordinators when taking pictures and scanning of parcels ?  I know Royal Mail do ... I'm going to send the buyer a message and see what he says

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am preparing an income and expenditure summary to send out to creditors. Do I have enclose a list of indivdual creditors and the balances outstanding. Or can I just lump them all together and put a total 'Unsecured Debt' figure.

 

I dont particularly want for the likes of Capital one and LTSB to see that there are 2 accounts for each company... one for OH and one for me. Especially as both the Lloyds accounts are in dispute and only one of the Capital one accounts is actually receiving a monthly payment whilst the other one is still waiting for the agreement to be received. There is no reason why you should have to name the creditors on that, just put Company A, B etc

 

Have you obtained any help with the figures you are 'permitted' to include, such as weekly shopping etc?

My personal opinion is to bunch them together, I've just done the same for Cap 1 for hubby as I don't want them to know who we are paying and then try and dictate who gets what. I didn't list any of the creditors, just a description like 'catalogue' or 'loan'.

 

Also, I've just received my SAR info from a previous mortgage company and they included a printout from their system detailing all actions taken on our account, including when we sent an I&E form in ad they had noted on our account what we were paying and that some creditors can be reduced, cheeky :)

Thanks for replying. jonni2bad. Last year CCCS prepared a budget for us. However because I wanted to sort out PPI problems and CCAs, I am managing the payments myself.

 

So I have just used the figures they gave last time. Where there have been increases I can prove if necessary ie.. oil, council tax, electricity and petrol I have increased those figures. The budget for food etc, I have more or less left the same, I will just have to try and keep the weekly shop within that. Everything apart from our income has gone up :)

 

I am using the same forumala for prorata monthly payments as CCCS used.

 

ananya, that is a bit cheeky. No wonder the creditors want us to telephone them, to put pressure to prioritise THEIR debt

Hi, Ananya/citizenb. Reminds me of the time cab sent I and E form to accounts on my behalf and the creditor sent snotty letter to cab stating I should allow less for baby clothes and give them more!!! The form only allowed small ammounts for kids, the usual etc and I think they were peed off at cab. I wasnt supposed to see the letter I believe, but when office closed down they offered me the file for reference and it showed some bickering from dca to cab. Cab said its was normal and they just ignore it. Thank goodness for them at the time, because they took the pressure off. Any way good luck and make sure you allow enough for you for food, dont forget how much that has increased too.

Stardust, they have already written saying that our expenditure is outside of THEIR guidelines.. Tough really, the only place I can really save money is on the weekly shop and I cant get it any less than it is already. :)

I recall one of the free debt advice agencies offering me advice about the levels for food etc etc and they were well in advance of any figures given "as advice" by DCAs.

 

I will see if I can find the links for them...

 

I too received the I&E from CCCS, so I just created a new one myself and dealt with creditors myself also. Have done ever since actually.

As you can see from this link - the grocery provision (per week) for 2 adults is £70, single adult £40, and £25 per child

 

The British Banking Association issued guidance for 'trigger' levels some time ago, the link HERE is old, but shows how, if you are within the trigger levels they advise, there will be no 'questioning' of your budget, but claim more and they are asked to challenge you. They took their figures from the Office of National Statistics, who produce a yearly report on levels of typical expenditure.

 

A sample of this, from 1999/2000, is HERE

 

It shows that a one parent family with (average) 1.8 children was spending between £37 and £65 per week on food and non-alcoholic drinks.

 

Average expenditure per person was between £54 and £163 (this is the "everything" figure")

 

Anyway, this all means that each DCA may well have its own trigger levels for each item of expenditure. I recall a telephone conversation with oneof mine, where the agent told me I couldn't claim for any form of excercise expenditure, but I could claim for cigs! Amazing...

Yes, when I was going through the figures last year with CCCS, I was told I could smoke 20 cigarettes a day (except I dont smoke) but I couldnt go swimming 3 days a week which is the only real form of exercise I can do due to a spinal injury !!.. Mad or what :confused:
