Wasn't sure what I should do next I should have tackled this at the time the default was issued. My mistake.

 

Had a default issued last April 2007 however most the the balance that was outstanding at the time was made up with Charges. I started action to get these refunded in the May 2007. I got the refund debit from my balance in September 2007 at the same time I was having financial dificulties and offered to pay a minium payments until my situation improved. This they accepted subject to the retention of all legal rights in default, wasn't sure what was meant by this however I continued making payments. I missed a payment in January 2008 and in February 2008 get a demaned from the Westcot for full amount.

 

What I would like to know if anyone can answer is, should I have been issued a default notice when most of the balance was made up of charges and is their anything I could do legally.

Hi Lizzy,

 

Have you sent a CCA request to see if they have an enforceable agreement for the a/c. If they don't, you can insist on the removal of any default info posted for this a/c.
