Hi, I am currently in the middle of the CCA process with Iqor, who are acting on behalf of Lowell.

 

I CCA'd them and the letter was signed for on 9th February 2008. The 12 working days was up on 26th February, and now I'm waiting on the calendar month deadline to expire.

 

I received a letter from them dated 21st February, which basically said that they have passed my request to their client (lowell I presume) for their urgent attention. They also stated that they had put the account on hold while they await confirmation from their client that my request has been actioned.

 

Well today I have checked my credit file and a default has been registered on my file on 24th February 2008 - 2 days before the 12 days expired.

 

This account wasn't on my file when I checked it in January after getting the original letter from Iqor.

 

Can they (Iqor or Lowells) register a default whilst the account is 'on hold' pending further information.

 

What can I do? I'm positive they wont have a true copy of the CCA agreement. Do I wait until the calendar month is up before highlighting this issue?

I'm shamelessly bumping this up again, as the calendar month deadline is today and I've received nothing.

 

I was wondering if there is a letter I can send to let them know they should not contact me again, and also to remove the default they have so nicely placed on my credit file.

ok, wait untill the 12+2+30 are up, after this time complain to your locan trading standards and OFT (thats the proper route)

 

me personally would threaten the hell out of clownells and iqor with legal action for a minimum of £1000 in damages and compensation as they have unlawfuly accessed your credit files without your permission

as to the contact you again blah blah blah TBH there no point to it, they will only ignore it and pester you more,

 

I cant tell you how many DCA's i've threatened (lost count). who was the original creditor and what type of account was it for ??

Further to the above, I have received this letter this morning - as far as they are concerned thats the end of it.

So how do I respond? Bearing in mind their continual updating of my credit file only began in February after they received my CCA request.

I've already sent a complaint to the CRA - only equifax has replied as yet - their advice was to purchase some of their products.:mad:

Further to my letter dated 7th April 2008, I have now investigated your complaint fully and would respond as follows:

 

I understand that you have not yet received a copy of the credit agreement for the above named debt as requested. I would not hesitate to offer my sincere apologies for the delay in providing you with this information. This has been as a result of the delay we are experiencing in obtaining the requested information from the original creditor, MBNA. Please be advised that we will endeavour to send you this information once it has been received in our office. In the mean time all collection activities remain ssupended in accordance with industry and regulatory guidelines.

 

As you may be aware, the information which we hold on you has been provided to us by the original creditor who registered the default on your account before it (the above account) was purchased by Lowell Financial Ltd. As the current data controller of this account we have an obligation to continue providing regular reports on the status of the account. Whilst we acknowledge that the debt is currently unenforceable as the documentation you requested has not yet been provided to you, we do not have any reason to believe that the regular account updates being provided to the credit reference agencies contain incorrect information or are in breach of any of the Data Protection principles.

 

Please note that under the terms of our Complaints Procedure this is our final response. Should it be the case that you remain dissatisfied you may refer your complaint to the Financial Ombudsman Service. You need to do this within six months of the date of this letter. For more information please see the enclosed guide 'Your Complaint and the Ombudsman.'

Iqor are doing a great job of distancing themselves from Lowell. got this letter today, along with my £1 PO.

My last correspondence to them was to request that they cease processing my data.

Does the fact that my PO was returned mean I now have to CCA Lowell and start again?

Incidentally have already sent my complaint about Lowell to the FOS and the ICO.

 

Dear Madam,

 

Further to our letter dated 21/02/2008 we are writing to up date you as to the progress of our request for a copy of your credit agreement. We have made our Client, Lowell, aware of your request for a copy of your credit agreement on 21-02-2008. We have reminded our Client of your request on a number of occassions but the copy agreement has not been provided to us to date.

We have now closed the account on our system and returned control of this file to our Client, Lowell. We understand that our Client will contact you directly regarding this matter. (they've already sent me their final response)

Please find enclosed your postal order valued £1.00 that we are returning to you uncashed.

Please be assured that we had no intention of causing any upset in our attempts to contact you to discuss repayment of the above-mentioned account. (sure you didn't)

iQor Recovery Services Ltd. has acted in good faith and on our Clients instructions in our attempts to collect the balance that our Client believes to be outstanding.

WE trust that this matter is now resolved, however, should you wish to discuss the matter further may we respectfully suggest that you contact our Client directly using the reference number shown above.

Let it run, Lowells know that you requested it and you have a letter telling saying this. my bet is it will now go quiet.

 

Will it be worth CCAing the O/C now? this way you will know if if they have one or not
