    • Is this sufficiant for a letter of claim  ? Letter Of Claim       Reference: Techzone Mobile Phones Samsung A71 Mobile Phone £140 Purchase date 29. 5. 24     I the claimant purchased a 2nd hand Samsung A71 mobile from Techzone Mobile Phone unit 10 of the indoor market at the Potteries shopping centre. Initially the phone worked well until I used the camera and found debris in the camera lens spoiling pictures making it not fit for purpose. I contacted the seller who offered a replacement which I initially accepted but later rejected and wanted a refund in full which the seller refused saying they Do Not give refund is unlawful and goes against the Consumer rights act 2015. Therefore I intend to issue proceedings against you in a county court without further notice unless you reimburse me the above amount in Full within 7 days from the date of this Letter     ------------------------------------------    I think its best if i hand him the letter as posting it might not get through so can claim expenses traveling up there ?   or would it be best to just post and get 'Signed for'  ?   Should i also put in the letter of claim interest added or leave that till the Particulars letter ?

No Did you inform the claimant of your change of address?  No - N/A Is the claim for - a Bank Account (Overdraft) or credit card or loan or catalogue or mobile phone account?  Bank loan When did you enter into the original agreement before or after April 2007 ?  No Do you recall how you entered into the agreement...On line /In branch/By post ?  I believe it was done online on their app Is the debt showing on your credit reference files (Experian/Equifax /Etc...) ?  Yes Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim.  Debt was with halifax, whom passed the debt to PRA Group. Were you aware the account had been assigned – did you receive a Notice of Assignment? Yes Did you receive a Default Notice from the original creditor?  I'm not completely sure at it was nearly 6 years ago, I have done a CCA request and they have sent a screenshot of their system showing it was sent. Have you been receiving statutory notices headed “Notice of Sums in Arrears”  or " Notice of Arrears "– at least once a year ?  Yes Why did you cease payments?  Couldn't afford to make payments. What was the date of your last payment?  August 2018 Was there a dispute with the original creditor that remains unresolved?  No Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan?  No
    • It’s all with current lenders and no missed payment to date. so with any reduced payment to them it’s likely to be going to debt collectors at some stage. we jointly own a property together me and my partner

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Cookies are just text files, most are there just to stop you having to log in every time you visiti a site (i.e. this one does the same, it keeps your name, your login and your encrypted password). When you click on "remember me" tick-boxes, it just means that it will keep that info in a cookie for you.

Indeed, Dave. Benign cookies have nothing to do with IE's comparative inability to protect you from online threats.

 

As CurlyBen quite rightly says, IE's ActiveX is a major - if not the single biggest - cause of unsolicited spyware / malware (and sometimes worse) getting onto your PC.

 

FireFox's code is fundamentally different. It is not that it has the same weaknesses as IE but deals with them better, but rather that it does not have these weaknesses to begin with.

 

It is simply a superior browser.

Quite right. If IE actually complied with the W3c standards, then I suppose it would be worth putting up with the security threats, but as it stands (and I'm told IE7 is getting closer to supporting the standards), for me at least, it's just not worth using. Not that I actually could use it any more, as I ditched Windows some time ago.

I only have IE installed for web development work, when I need to be sure my websites will look the same in IE as they do in real browsers.

 

It has to be said, for W3C, IE stands alone in the range of browsers as being the only one that often seriously mangles - or worse, ignores - standard code. I've never had to write patch code for any other browser.

Ok, have got firefox working, and got the CAG toolbar. What I haven't got is any of the buttons/options when I try to post a message (things like bold/underline/italics, colours, smilies etc). Have I done something wrong, or more to the point, what do I do to get them back.

go to View, Toolbar, make sure that the Navigation, Google and Cag toolbars are ticked

I knew this would happen. Navigation and CAG toolbars are ticked. No google option to tick, but not bothered by that. Next, I thought I would look at the CAG bar, as a big red circle has appeared. It tells me I have not logged in, and to go to the options menu to log in. Entered my user name and password....nothing happens. So press it again and my password (all in xxxx's) is about 30 characters long. Still no buttons, and worse, the text is coming out like this (in one lock block) instead of the paragraphs I am typing. HELP

Indeed. I personally don't use the CAG toolbar plugin, but I've just done a test install and it works perfectly.

 

It also seems to work perfectly for other users, and the thread for it reports none of the issues described, so it's rather looking like something unique to louis' system is causing this issue.

Search for Ad-aware free edition and install it. It used to work wonders for me.

Also when you are running CCleaner, Spybot and Adaware make sure they are the ONLY things running.

Close ALL browsers, e-mail and IM clients.

 

If you are still having a problem then reboot and run them again.

Be VERY careful whose advice you listen too

Should they actually stop the pop-ups from happening? Or just protect your computer from any adverse effects?

I've downloaded EVERYTHING - still getting pop-ups, but hopefully nothing nasty will happen to my PC from closing them.

 

If you are getting this popup even when surfing CAG, which I don't believe uses advertising popups, then the problem is that you have something nasty running resident on your system.

 

The programs mentioned by CurlyBen and others should remove this issue, but may not take effect until after you reboot your PC.

I thought I had better have a look at this before moaning about it. Have managed (I think) to solve the problem by right clicking and clicking the 'allow cag' icon.

 

Simple for most, but really had me scratching my head. Still, all seems ok now, will persevere with the 'odd' layout (a few things in different places), and hopefully experience all the other benefits in time.
