I've made a silly mistake yesterday by forgetting a Direct Debit was due. Halifax charged me 35 pounds because I was 13 pounds short of the D.Debit amount.

I rang to find out whether they can wave it for me and they told me NO they can't because I took legal action against them in 2006. I got all my charges refunded in December 2006 and was doing brilliantly since October 2006 with no charges.

They said that I agreed to the terms and conditions of accepting the charges in future and that they can close my bank accounts with them!

Has anybody had this? Can I write to them asking for my money back OR should I just let the charge go?

17 November - Prelimanary letter

25 November - Confirmation of receipt from Halifax

29 November - letter from Halifax Goodwill gesture £318 out of £408 (original claim).

6 December - Rejection/LBA Letter sent

18 December Halifax letter offering £408

18 December - MCOL completed - claiming interest and costs £523

28 December - Won! Money in account!

Hi, Andrea450.

They shut my account after my first claim, It's really up to you. I think you can claim again, but is it worth the hassle?

Regards.

Scott.

Any advice I give is honest and in good faith.:)

Sorry to hear about what they did to you - totally out of order - did you get your money back?

Yeah you are right about the hassle, but why are they still getting away with charging such enormous amounts for paying out pittance for us?

Credit cards are charge 12 pounds if you pay late etc.

Why are banks still getting away with charging such extortionate amounts?:-o

Andrea, it might just be worth a quick phone call asking for a refund, the worst they will say is no, but you may get a good result.

Hi Andrea450,

It will be £35 this month + I would imagine a £28 unauthorized overdraft fee, which am I am sure you have not got lying around to pay the big fat shear holders, therefore you will be down £63 next mouth which might leave you sort for next mouths outgoings, and Halifax will not give a dam and the circle of chargers may begin.

Good old customer sieves is non existent in the banking industry unless you have Money.

In answer to your question, claim it back they will soon get feed up when you claim back £35 they then have to pay you back and the fees.

What have you got to lose?

  • Haha 1

Best Regards<br />

Yep, I made a mistake by going down the bank charges road again. However, I will learn from it and try harder to manage my money more sensibly- and I will definitely ask them for my money back!

I'm trying to claim PPI from them too, so I bet I'm in their good books at the mo!:|

Yes, I had one Small Claim for £1,027.20. and one Summary Cause Claim for £1,051.60.

I like showing the total amount's as every penny you get back from the bank counts.

My third claim is with FOS, It's for £5,000.(could do with winning that one.)
:)

Hi,

Sorry to 'hijack' your thread here but I'm in exactly the same boat although I went over my agreed limit by only a few quid. £63 I'll be charged for this!

I've claimed from them in the past and I want to know if I should do it again. What's happening about the test case?

The 'test case' could rumble on for a while, you should get your claim in.

Yes you can claim again, try phoning them first you just might get your money back. as for the test case it is still going on you can update on a thread in this forum " the Prime ministers website " or on bbc online/ business then search for test case.

and for Andrea, if they do attempt to close your account, they are not allowed to, make a compliant to the Financial Ombudsman, in fact tell the bank that if they do close your acount as punishment for cliaming your charges back you will complain to ombudsman. It might make them think twice.
