      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Cost of producing Fuel (from a website)

 

Crude extraction 8p per litre

Refining 2p per litre

Transport to UK 2p per litre

Transport to pumps 2p per litre

UK Taxation 70-75p

UK Average price Now over £1.02 per litre (with profits added)

 

The Government recently had a windfall of over £3 Billion due to the soaring cost of a barrel of crude. This means, that fuel prices could have been slashed by up to 9p per litre. Did the Government do this? Did they hell ! Greed is what seems to fuel the people in power and this is what it is all about. GREED

However as far as I understand you send off the form to pay the tax every month (in arrears), therefore you only pay the tax on the veg oil you've actually used. I would have to dig the information off the Govt. site to be totally certain.

 

Solution - if you happen to be caught, tell them that this is the first month that you are running on it, and the form with a cheque for the VAT is in the post!

 

Oh, and if you are running on veg, keep a check on your fuel filters...

Yesterday I was down in Co. Donegal to visit my girlfriends family. The filling station I stopped at had pumps marked in sterling as well as euro's. I got 33.75 litres for £30 @88.9 as opposed to 107/108 up here.

The one thing I can't understand, if any of you can explain it, is. down south diesel is cheaper than petrol whereas up here it's the other way around. The only reason I can think of is the duty charged on it.:confused:. These price rises seem to be happening almost daily so we need to do something soon. We have to bear in mind there are other factors causing the price to rise, but the government has to take the blame for it being so high in the first place.

Back in 97 (ish) the current government stated that they would always maintain the cost of diesel at least 10p a litre lower than petrol. At the same time the auto industry and us (the consumer) were encouraged to develop / buy into diesel fuelled vehicles.

Call me a cynic, but now a lot of us are using diesel vehicles. . .the price ratio has changed. . .

Furthermore, diesel hydrocarbons have a higher carcinogenic value than petrol emmissions. . .

Where there's a will, there is a way! We have the will and we will always find a way!

concerning veg oil, my understanding is that if you are a producer of less than 2500 litres a year, then inland revenue are not intrested, and producers below that level have been asked to deregister.

I received this e-mail today about a fuel protest:-

Last week I was informed that a group called Transaction 2007 had plans this weekend to release a statement announcing some kind of protest action relating to the price of fuel in the UK. I have just read a statement published on their web site in which they have confirmed that they are going to organise legal protest action, and that it could begin as early as this Wednesday.

Yep, it really is time to stop sitting on our hands and have a go at making our voices heard.Of course they (the government) are unlikely to listen. . .but, you don't ask you don't get!

 

We could of course strike back at the "big boys" by setting up our own buying group? It wouldn't have to be limited to anything in particular. . .legal services, insurance, etc.

 

I have seen mention of a credit union as well. . .anybody know if there has been any progress?

So what's the story so far. I have heard nothing on the news so far about any protests.

So far, it is 106.9 for unleaded and 113.9 for deisel round here. Just across the border it works out at 89.9 for unleaded' Quite a difference over a tank full.

So far, it is 106.9 for unleaded and 113.9 for deisel round here. Just across the border it works out at 89.9 for unleaded' Quite a difference over a tank full.

 

it happened very quietly....they chose one of the coldest days of the year to protest and not many people turned up.....:(

 

they need to organise protests when the weather is a little better and to publicise it more

Does anyone have any idea why the price of diesel has went up while petrol has remained unchanged. For example; the local BP station was 107.9 for petrol 113.9 for diesel. Now it is 107.9 - petrol, 116.9 - diesel. I also heard that retailers are charged the same price for fuel. If this is true, how can one part of the country charge more than another?

Yes. I have a pretty decent idea. It's because this government cannot be taken at their word. Everything they say is a facade for lining their own pockets.

 

The diesel v petrol argument is barely the tip of the iceberg.
