requested the cheque by fax, I have absolutely everything in writing, probably more than what they have kept so well sorted on that point.

 

They are just trying it on.

 

On a side note, I called them up, no number to hand and only one I can remember is Michael Rhodes so I called that. His pa was at lunch and the man himself picked it up. Totally flumexed, I missed a prime opportunity to tell him exactly how crap his company is, he didn't know who Gareth was so presumably he just numbers his staff. Damn, gutted I missed out.

I think it is true they were out. Apparently Wednesday, thursday and Friday.

 

Anyway, I have just had a cal back from Gareth. nice lad, always stressing that they are trying to help me (I think he genuinly is). Anyway, upshot is that they will now send me the £330 and then I can pay them back my monthly payment. I have suggested that he just makes 2 cheques out. One for them for the payment and the other to me for the difference and he is gonna come back to me on this.

 

He also stated that fees have been supressed on the account until end of August. I kinda suspected that as there weren't any on my last statement. This is so as not to further muddy the waters whilst everything else gets sorted.

 

Anyway, just waiting for Gareth to call back and we should be all done then, unless I have forgotten anything ?

Do you have Gareth's phone number to hand - still no response to my emails and no Data received - 7 days till the 40 days is up - would prefer not to have to take them to court for my data.

SS It might be that they are as anxious as you now to get you sorted...so that they can devote a little more time to the doubtless 1000s that are in the queue !!

 

And prob a lot more than 330 quid too

Spikey, try this one 01244 672628, that's the advocates office.

 

Gareth did sound like he wanted things sorted. He genuinely is a nice lad and I think it would be very difficult for anybody to give him a hard time over the way he deals with you. But then, as we know, the arguments are really with the banks policies and not the staff who are just there to carry our orders.

 

Anyway, Gareth is coming back to me tomorrow with an answer on the cheque thing anyway, just makes it a bit easier all round if he can do it.

just rang - was sent to my old address (moved 2 years ago)!!!! acording to their records i never changed my address, funny how i was receiving statements to my new adress up to around 3 months ago, not to mention i put my current address on the DPA letter.

 

 

These guys really are shocking

spikey, go ballistic mate. ask them what they intend on doing to rectify matters. The fact that somebody else now knows you spending habits is quite embarrassing and what other info have they now got that could be used fraudulently if the new occupiers of that house were that way inclined. Blatant balls up on their part, make them suffer.

 

Remember, to make a claim through the courts under DPA you must also suffer damages as well as distress. Record the cost of calls and letters etc and then bang the distress claim on top of that.

I Have to agree with Stu, and the moderators explaining the laws. i think its a bad idea, and u know when u open a credit card account u have entered into a contract (they send u enough small print about it which nobodys reads). You know u have to pay them back and pay interest on the money you borrow. You even know you have to pay penalty charges although thanks to the OFT we can now dispute this.

 

I appreciate that many people come into difficulties due to personal circumstances and if MBNA persecute these people then i feel sorry for you and dispise them for that. but some people just borrow too much (thats my probem) and manage there accounts badly. Only we are to blame for that. Ive decided to become a rate tart and move my balances around to nil interest accounts to try and manage, have to see how i do, but working so far, about 6K to pay off, but at least there no interest at the monemt and less stress.

 

I also dont believe in making the staff there have a hard time dealing with all the mail u about to send them, they just like u and me working for a big organisation doing what they are told to do. At the moment theres proberly alot of stressed staff having a bad time which spills into there personal life, just looking at it from a personal point of view, happy work makes happy home life. Im sure they got enough on there plates with the penalty charge refunds.

 

I wont rant anymore as im sure you all hate me, and im sorry but thought id have my say. Im thinking its all getting out of hand and with all these refunds all the banks are having to refund (and im one looking for a refund) we will be penalised some other way in the form of increased borrowing rates.

 

PS i dont work for a bank or credit card company, im an IT manager with a large hotel company.

We are all angry with the banks, and I am certainly not justifying how they have treated you.

 

But the last thing we would like to see is you ending up in some serious trouble.

 

You seem prepared to stand in front of a judge and claim that you have no agreement with MBNA - yet you have used their credit card.

 

Would this not amount to credit card fraud? Surely this can end in charges being bought against you.

 

At the very least I am sure the judge would not be impressed at an obvious abuse of the legal system, and would be very unlikely to find in your favour.

\just finished reading this. I have a claim against MBNA for non compliance of DPA AND the IO has upheld my complaint yet still they are defending. Any hot tips from SS in this matter?
