  1. Bailiff company in question perhaps trying to stop it getting shown. Has the potential to lose contracts and damage buisness.

  3. Has anyone seen the dispatches programme on this subject tonight. Interested to hear thoughts on this ive got very strong views myself. The book titles gypsy and traveller law is a very interesting read for anyone interested in the subject.
  4. Ok, so you've got a levy on your car. So how much is the debt for? (including fees from the bailiff) Is your vehicle on finance? You say you are self employed, is the car registered to your buisness, and is the insurance personal or buisness use? If the answer to any of those questions is yes then the bailiff cant take your car in theory, unless the removal and subsquent sale of the vehicle is enough to pay the outstanding finance as well as the debt and fees accrued. Has the bailiff been told the car belongs to you or has he seen it on your drive or been told by a neighbour its yours and posted the levy? If its been confirmed its possible it could be passed to the anpr bailiff vans who go around looking for cars to clamp. Have you explained your circs to the local council? If so what have they said?
  5. Very misguided advice above, if it is a parking fine then if equita are involved a warrant or two in this case have been issued. It will of been issued at northampton county court. Regards registration documents, if its a matter of altering your surname i dont think it would make a difference to either the council or bailiffs, as you are still the same person. The only info that the dvla will give is who was the registered keeper when the offense occured hence why its in the other name. If you havent corresponded with bailiffs or council they wont be aware of your condition, and the parking section wont have anything to do with the benefits section. Have you tried contacting the council explaining your vulnerbility? Also is your car on finance and is it worth any money? Reydetinu, its not a judgement so cant be set aside, it has nothing to do with magistrates, and a warrant not a court order has been issued. The bailiff doesnt need to carry the warrant UNLESS removing the vehicle in which case a copy should be left at the address.
  6. Clearly a parking fine. Worth mentioning here you seem to suggest that the cheque/payment you have sent is going to discharge the pcn, but dont forget here the bailiff will take his fees out first so the pcn will still be outstanding. To be honest i would advise you to pay this off, reason being if newlyn attempt further calls they may charge again ( can charge for upto 3 visits for parking fines) but worse still, if you still own the vehicle it relates to Or have a drive where you park, could clamp and remove your car, and no prizes for guessing who would end up with the bill for the tow truck. I know plenty of people on this forum would advise otherwise, but i think it would be better to pay it off, certainly beats hiding your car everyday in the hope its not spotted, or found by anpr cameras, and being on tenterhooks everytime you get a knock on the door for 12 months until the warrant expires. Oh, have you perchance, moved properties since you got the fine? If so approach the court to explain this they have to look into it, and if successful havd to start the process from scratch, its called a late stat declaration.
  7. When you take out a loan and give them the logbook, do they not take ownership of the vehicle until you pay off the debt? Then they let you keep the car on the understanding that they can come and get "their" car back should you not pay? I ask because thats how i interpret their agreement off the website. Would they not then need a court order to take the car as long as an employee/contractor of logbookloans comes to fetch it? As a result they wouldnt have to employ a bailiff as there wouldnt be a court order and just a debt collector?
  8. Anpr is automated number plate recognision. Its similar to the ones in police cars, only bailiffs wont get up on screen whether the cars taxed/insured. In fact the only info bailiffs are entitled to relates to whether the vehicle the fine relates to is still registered to the person who was the registered keeper at the date of the offense. (slightly off topic here but bailiffs are not entitled to contact the dvla for anything other than that yes or no answer for penalty charge notices for data protection reasons, so if you read a thread that says a bailiff has to check the vehicle is registered to a debtor before taking for council tax debts, that is not the case because the dvla will not release that sort of info)
  9. Bailiffs have the use of anpr vans with the respect of parking fines, expect them to go around public car parks searching for cars. Tesco, or any other supermarket are private property. Bailiffs can only go onto these car parks with permission, it is quite possible tesco have given permission to the council for this purpose, maybe thats why bailiffs are searching tescos car park?
  10. Did you have a formal tenancy agreement? If so does it clearly state which bills you are responsible for. If it was just a verbal agreement, the onus falls on the occupier of the property at that time, (unless it a multi-occupancy property in which case landlord would be liable)
  11. Unlike council tax - there does not have to be a levy of distress in place to add an attendance fee. I assume the warrant is in your mothers name, and unfortunetly even though the fine was your fault as the law stands the bailiffs must seek to recover the debt from the registered keeper. So calling the police if they turn up may well be a waste of time. Also, be aware of automatic number plate recognition vans who if they drive past, could clamp and remove the car on the spot
  12. just show them your id or tenancy agreement and they will go. simple if you speak to them if they call at your address as suggested in earlier post (telling them rudely to go away etc) and shut the door on them, they will most likely think you have something to hide and could possibly be the person they are after.
  13. i thought if you record someone without either informing them or asking there permission, and try and use it against them, it would be inadmissable in court?
  14. I would agree, its his 1st visit and he didn't levy on your car, so personally I would tell him to Foxtrot Oscar. If you want your fees take me to court. He can clamp your vehicle for bailiff fees. in response to this:- unlike council tax, the bailiff doesnt have to levy to charge the fees because if not levying then the fee goes on as a visit fee. so the fees are valid i would of thought, so should be paid.
  15. i have heard of a similar scenario with another company who did work around the derbyshire/peak district area, the councils had to knock the money off each individual bill if the people provided bank statements or receipts. cost the councils a lot of money overall by all accounts. the company was jackson heath bailiffs.
  16. the problem with going down the route of stopping the director becoming a director of any other companies is most people faced with that possibility get a 'fall guy' or 'puppet' to become director rack up a load of debt, move on to the next victim and so on. and as previously said you have a judgement in the name of the ltd company not the individual themselves, so bailiffs/hceo's would be wasting their time and your money by visiting home address. many people register their ltd companies at a home address knowing full well bailiffs have no powers at the domestic dwelling.
  17. if the buisness has not been made insolvent then yes bailiffs can chase you. unless you have a car or something still registered to the buisness, bailiffs can NOT enforce a liabilty order for a ltd company at a home address . they have probably got your address from companies house.
  18. surely to god you dont need to ask people how to pay your tickets. you have been lucky enough to have the charges reduced so pay them online or call them and pay it. if they have visited and left letters you will have the number or website.
  19. could you be clear whether it is business rates or council tax you owe as you refer to the debt as "council tax business rates" in your original post. the reason i ask is because i found an interesting chart online for the manchester council and bailiff fees and i thought i would share it with everyone. 1st and 2nd visit fees - £24.50 and £18.00 for council tax and non domestic rates. £120.00 c.tax flat fee and £200.00 ndr(£300 if debt to council over 10k)- attendance with view to remove/enforcement/van call (or however differing companies wish to refer to it as) £30 every half hour waiting time chargable after the initial hour (and £50 for ndr) £12 standard walking possession charge. this goes for every bailiff company that works with the council apparently.
  20. could anyone help and provide me with the name of the insurance company that IS affiliated with them - as my grandparents have been conned by two differing companies insinuating they are providing cover. they could potentially have 3 polices on their sky boxes and internet. i have answered a call today from SRS satallite services, the woman claimed to be the only company directly associated to sky, she said our policy has just expired, that is why she is calling - we have no record of the company letters etc. what got me is for such a large company she told me if i call back to ask for her giving her first name only. and looking into it they have policies with skylite insured ltd AND IDS independent digital services ltd. i am taking this very seriously as i have had to deal with debt collectors over the phone because one of the companies had not taken a dd payment about 6 months ago. im certain i heard about these companies on watchdog a few months back.
  21. with regards greenpimpernels earlier post about ltd companies- people that do this are the whole reason other buissnesses suffer because to recoup lost revenues everyone elses bills go up. and personally i find it disgusting that people/companies are allowed to get away with this every year and that the info on how to cheat the system is so readily availible. i know a lot of pub companies do this to cheat themselves out of thousands of pounds of debt every 5-6months, slighly changing their name each time (Eg xyz ltd, then xyz uk ltd then xyz limited etc)
  22. why are you making an issue over this, just send in the info then they wont call. why are you getting wound up the only reason they are calling to your address is because that is what they they were given. just because you say it is harassment doesnt make it so. if it was me i would call them and say look i live here now send someone round i will show them my id or contact the local authority they will tell you i pay council tax.
  23. amount does suggest he/they have visited before, and legally they have to send a letter out before visiting at a cost of 11.20 +vat (13.16) knowing equita they dont do 1st and 2nd calls choosing to illegally send letters including charges on them. crucially unlike council tax, bailiffs can charge an enforcement fee/van fee for parking fines regardless of whether a levy has taken place or not so why he felt the need to write one out anyway is a pointless exercise
