  1. You apparently don't even know if there was. CCJ so I wouldn't worry about it. And if there had been a CCJ why might it not have been enforced up to now? You are right that if the CCJ exists it is possible for a debtor (not a debt collector unless they have bought the debt) to apply for a court order to enforce after six years but this would be very hard for them to get. I can't remember when I last saw a successful case of this happening although it does happen from time to time. They would have to show exceptional circumstances why they had not enforced before. eg you had been out of the country ever since and only just retu

  6. They think they're being clever by making motorists pay £100 instead of £60 with their sordid little scam. The problem for them is that people like you, who quite rightly have decided to pay £0, easily have the upper hand legally and would hammer them if they were daft enough to do court. To the list of their disasters we can add mitigation. The only way their attendant could have been afraid that you might beat him up is if you were nearby. In that case the attendant should have mitigated the loss by telling you either to display your permit or move to another part of the car park.

  11. Sorry for the delay in getting back with the update. Livewell Today did not do anything at all and their engineers report was incorrect with the fault, which i fixed myself in the end, it was a wire of the key switch, which the engineer should have picked up but didnt . so after i fixed the scooter and used it for a week i sold it and got another one ....i left an honest but scathing review on their website and through trust pilot case closed.....many thanks for your help and advise on this one

  13. I think it was your response to their claim form that scared them off. We would normally leave that until the Witness Statement because that doesn't give them enough time to counteract a good WS. However DCBL are cowards just like their bailiff section all bluster and heavy with people who don't know how to deal with them but back down quickly when up against tougher opposition. I read your defence again and tried to think who wrote it as one of the things that it did was to point out the failings in the cases that the rogues often put in to help their flawed arguments. didn't sound like anyone from MSE and National Consumer Service hav

  14. I'm sure you could have done without a year's hassle from these crooks. However, think of it as a learning curve so you know what to do in the future should something similar happen again. Sadly the vast majority of motorists who get these invoices think they are fines and something terrible will happen if they don't pay so they give in. You didn't. Well done.   15. Indeed they may have. But you will be required to submit them again when you accept the fixed penalty. The instructions will be with the offer. It's up to you whether you want to ignore those instructions or say something like "you already have them." But if you do, the offer will be withdrawn and your case will move to court action where, as I said, the cost will be considerably greater. It's your choice but I mentioned it so as to avoid you any further trouble. Believe me, I know about these things.

  16. This is about the worst PCN I have ever seen. No attempt to include a period of parking. Denying you the right of appeal as you've accused "either/or" of two completely different offences so haven't a clue about what you're supposed to have done wrong. As the others say no mention of POFA and sent out too late for keeper liability.   17. Doesn't mention POFA at all either. So only the driver is liable and not the keeper. Simply don't tell them who is driving and you're in the clear. In simple terms, this means don't appeal. APCOA has never done court in any of the case we've had here since 2017, so clearly not in their current modus operandi. Ignore them totally until you get a letter of claim, then come back here.

  19. Hi there. I have just received notice that DCB Legal has discontinued their claim against me. What a relief. I'm hugely grateful to all of you for your help in fighting these people and their evil business model.
