    • I have also found this:  D.2 Service of a PCN by post: 54) There are some circumstances in which a PCN (under Regulation 10) may be served by post: 1) where the contravention has been detected on the basis of evidence from an approved device (approved devices may only be used in limited circumstances) 2) if the CEO has been prevented, for example by force, threats of force, obstruction or violence, from serving the PCN either by affixing it to the vehicle or by giving it to the person who appears to be in charge of that vehicle 3) if the CEO had started to issue the PCN but did not have enough time to finish or serve it before the vehicle was driven away and would otherwise have to write off or cancel the PCN 55) In any of these circumstances a PCN is served by post to the owner and also acts as the NtO. The Secretary of State recommends that postal PCNs should be sent within 14 days of the contravention. Legislation states that postal PCNs must be sent within 28 days, unless otherwise stated in the Regulations. This from London Councils Code of Practice on Civil Parking Enforcement.  The question is what is an approved device? Certainly, he had the opportunity to place the ticket on my car and I didn't drive away.  I looked further and it seems that an approved device is a CCTV camera - It seems that the photos taken were not actual film but images and it is not clear if they are taken from a video or are stills. I'm guessing if it was moving images then the SAR would have stated this.    From the Borough of Hounslow website: "There are two types of PCN issued under the Traffic Management Act 2004, which governs parking contraventions. The first is served on-street by a Civil Enforcement Officer, who will observe a vehicle and collect evidence before serving the PCN either by placing it in a plastic wallet under the windscreen wiper, or by handing it to the driver. The second is a PCN served by post, based on CCTV footage taken by an approved device, which has been reviewed by a trained CCTV Operator."   From Legislation.gov.uk regarding approved devices: Approved Devices 4.  A device is an approved device for the purposes of these Regulations if it is of a type which has been certified by the Secretary of State as one which meets requirements specified in Schedule 1. SCHEDULE 1Specified requirements for approved devices 1.  The device must include a camera which is— (a)securely mounted on a vehicle, a building, a post or other structure, (b)mounted in such a position that vehicles in relation to which relevant road traffic contraventions are being committed can be surveyed by it, (c)connected by secure data links to a recording system, and (d)capable of producing in one or more pictures, a legible image or images of the vehicle in relation to which a relevant road traffic contravention was committed which show its registration mark and enough of its location to show the circumstances of the contravention. 2.  The device must include a recording system in which— (a)recordings are made automatically of the output from the camera or cameras surveying the vehicle and the place where a contravention is occurring, (b)there is used a secure and reliable recording method that records at a minimum rate of 5 frames per second, (c)each frame of all captured images is timed (in hours, minutes and seconds), dated and sequentially numbered automatically by means of a visual counter, and (d)where the device does not occupy a fixed location, it records the location from which it is being operated. 3.  The device and visual counter must— (a)be synchronised with a suitably independent national standard clock; and (b)be accurate within plus or minus 10 seconds over a 14-day period and re-synchronised to the suitably independent national standard clock at least once during that period. 4.  Where the device includes a facility to print a still image, that image when printed must be endorsed with the time and date when the frame was captured and its unique number. 5.  Where the device can record spoken words or other audio data simultaneously with visual images, the device must include a means of verifying that, in any recording produced by it, the sound track is correctly synchronised with the visual image.
    • Hearing took place today.  Case dismissed with costs awarded. Neither UKPC or a representative turned up.  Apparently they messaged the court on 7 May asking for their case to be considered on paper.  Never informed me, which was criticised by the judge as not following procedure.  I was really annoyed as I would have preferred for the case to be thrown out before the hearing, or at least face them in court and see them squeal.   They are just playing a numbers game and hope you blink 1st!   Ended up having to change my flight, but  the costs awarded softens the blow. Was asked to confirm it was my signature on both the witness statement and supplementary statement.  Wasn't asked to read them, said she could see my arguments made and the signs were insufficient and no contract formed. Took maybe 10 mins in total.  Judge did most of the talking and was best for me just to keep quiet or confirm any statements made. Happy to have won as a matter of principle and have costs awarded. Maybe not worth all the time and hassle for any newbies or the technologically challenged.  But if you are stubborn like me and willing to put in the time and effort, you can beat these vultures! I big shout out to everyone who helped on the thread with their advice and guidance, special mention to FTMDave, thank you sir!  Really appreciate everyone's efforts. All the best!
    • I plan to be honest to avoid any further trouble, tell them that the name should be changed to my official name
    • There is no evidence that I was issued a PCN that was placed on the car and removed. It seems that I was issued a £60 PCN on the 8th of March (the parking date) but it was never placed on my car, instead,  they allege that they posted the PCN on the 13th of March and deemed delivered on the 15th. I never got this 1st £60 PCN demand. I only know about all of this through the SAR. I only received the second PCN demanding £100, which was deemed delivered on 16/04/2024 - that is 39 days after the parking incident.  I did a little research and "Legislation states that postal PCNs must be sent within 28 days, unless otherwise stated in the Regulations." as per London Councils Code of Practice on Civil Parking Enforcement.  The main issue is that I was not aware of the 1st £60 PCN as I didn't receive it - I'm not sure how this relates to the 28-day rule because that rule applies to the initial £60 PCN. PCM could say that "we sent him the letter by post and it was deemed delivered on the 15th of March" therefore the 28-day rule does not apply.  As regards the safety of the parking attendant, that is clearly something he chose to feel and he made the decision that his safety was threatened - I didn't even see him or had any interaction with him. I'm nearly 50 and I definitely don't look aggressive 😊

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Evening Slick,

Sorry I haven't worded myself very well. I was referring to the fact that we are aware that the ICO has said that microfilm is acceptable -

I don't think there is an offical report out there - is there? I have read through the sticky's and don't think there is anything I can "officially" use.

Do you think I should put a complaint in with the ICO? Has anyone in your knowledge ended up in court, or have they given up just before the court hearing?

Hi Kate,

 

In your POC, you can say you are aware that the ICO considered BC's Microfiche data storage system back in November 2006 and concluded that the microfiche system used by Barclaycard is a relevant filing system for the purposes of the Data Protection Act.

Some cases have gone to court, although BC will probably try to supply some of the older older data before any proper hearing.

Below I have entered a copy of my POC, I have used the CAG templated and included info about the ICO. Just thought if anyone else needed an example it is here.

PARTICULARS OF CLAIM

 

 

1. The Defendant is a Data Controller within the meaning of the Data Protection Act and is responsible for the processing of data of which the Claimant is a Subject.

 

2. The Claimant had an account number XXXXXXXXXXXXXX ("the Account") with the Defendant which was opened on or around XX/XX/XXXX and closed on XX/XX/XXXX.

 

3. On (Insert Date) the Claimant sent a Subject Access Request, pursuant to Section 7 of the Data Protection Act 1998 to the Defendant.

 

4. The Defendant has failed to comply, and only submitted 3 years of statements which were blank apart from the outstanding balance and account number. No other documentation has been received as requested in the original Subject Access request.

 

5. The claimant is aware that the Information Commissioners Office (ICO) considered Barclaycard's Microfiche data storage system back in November 2006. The ICO concluded that the microfiche system used by Barclaycard is a relevant filing system for the purposes of the Data Protection Act.

 

6. By virtue of the Defendant's failure to comply with the Subject Access Request the Claimant has suffered damage

 

7. The damage caused is:

 

Extra costs incurred in addition to court costs, due to the Defendants failure to comply - this includes the cost of additional correspondence and time spent preparing documents and seeking legal advice, I estimate this cost to be £100.

 

8. The Claimant seeks an order that the Defendant do comply with the Claimant's Subject Access Request

 

9. Under the terms of Section 15(2) of the Data Protection Act 1998, where the Defendant contests that information requested under the Claimant's Subject Access Request is not included within the scope of Section 7 of the Data Protection Act 1998, the Claimant requests that the Court inspects that information, and where it finds that the Defendant's opinion is unfounded, that it orders such information be included within the information supplied to the Claimant under the Subject Access Request.

 

9. Damages and costs within the discretion of the Court.

After my N1 was submitted I was advised they would be defending the claim in full!

 

Received a call yesterday advising I would receive a copy of all my statements from 1998 till the account closed, and I would have them later this week.

 

Great result - really happy!

Who actually called you and did they mention your claim for damages and court costs.

 

Well done to you for pushing ahead with your action for Disclosure. Excellent result!! :-D

 

Lets just hope the statements or data show older charges which will bring good rewards with compound interest in restitution.

I had a similar experience. At first BC claimed they didn't hold date over 6 years. When I submitted an N1 for non-compliance with the DPA they changed their tune to, 'we have the data, but we don't have to give it to you (because it's on microfiche)'. Then a week before the hearing they coughed up the extra 2 years worth of data (so 8 years in all).

 

Anyway, you're in good hands with Slick - he helped me enormously with my BC claim last year

Hi guys,

 

I am now trying to reclaim my charges back from Barclaycard.

 

I thought I would start the thread so people could see how I get on, and as it may help others trying to do the same.

Any advice or help along the way would be greatly appreciated.

 

The charges only worked out to be 350 pound, but as they were going back to about 2000 it totalled up to over 3,000.

I used the following link and advise to work out the figures.

I was really shocked at the total.

I added their CI and 8% statutory interest.

Reading through the threads I wasn't sure whether to add the 8% at this stage but thought it would always give me room for negotiation later on.

have also read that it is likely that I will probably have to go down the court route to get anywhere with them.

 

A week after sending my initial letter I got a letter back saying that they couldn't confirm who I was as the address they have on file is different, this is a load of rubbish as I have been dealing with them over a different issue for over a year.

 

I wrote back to them expressing my annoyance etc and told them they had to stick to the original time scales, which has already passed. So if I don't hear from them by Monday I will be writing back to them.

 

Will update the thread when I have an update, any advise or help along them way, or about the above, as always is appreciated.

Not sure what you mean by your PS.

 

BC won't pay up without you issuing court papers. Be prepared for a little scuffle with them.

 

Make sure this is worked to your time scales and not theirs.

Hi Kate,

 

Good to see you starting this reclaim including all the older charges.

 

Nothing has changed with credit card penalty claims. As ims says, BC will refuse to repay charges that are over 6 years old and/or include compound interest claimed in restitution. You'll have to take it to court and be prepared to go to court on the day if necessary.

 

But in practice, BC will back down and settle before the hearing date. If you're lucky, you may even be able to save a few trees and avoid having to submit your court bundles.

Just an update on this one.

Sent off the letter which dpick kindly posted on thread#2

- they responded by sending a copy of the application and and t&c's a month later.

 

Sent another copy of the letter and all went quiet till recently.

We started receiving calls from HFO about a month ago.

 

The strange thing is I have no idea where they got our number from.

We moved house just under a year ago, they had our address but we learnt the hard way and when we moved we gave no creditors or DCA our telephone number. We are also ex directory.

 

The same guy kept calling and leaving messages,

eventually I spoke to him and advised that any comms should be done via writing and nothing would be discussed on the phone.

He tried to push it - and I just repeated myself that we would not speak to anyone and ended the call.

 

Received a letter asking us to call again to discuss the account.

They sent another copy of the application and and t&c's.

So I have sent them the same letter again.

 

Wonder what they will come back with or whether it will be another year till we hear form them again.

Would really like to know where they got our number from? If they keep calling I will go down the harassment route.

here is the update on my Barclaycard charges reclaim.

 

Sent initial prelim reclaim letter inc schedule of charges

- Barclaycard kindly replied saying they would not refund due to the charges being over 6 years.

 

LBA sent today advising that I will rely upon s.32 of the limitation Act 1980 citing the case of Kleinwort Benson v Lincoln City Council.

 

They now have 14 days to reply before I will be issuing court papers.

 

Lets see what they come back with - will update when I know more.

HFO are now getting really heavy with their letters. It looks like they are now going to be taking legal action to pursue the debt.

 

Despite sending dpicks letter on numerous occassions they don't seem to be letting up.

 

To add a twist to the tale (this is actually my partners old BC) a year ago we checked his credit file to find a CCJ on there.

We never had any idea of this and were never notified about it.

 

I did post up a thread about it on CAG to get some advice as I was really annoyed to find you could be issued with a CCJ and not even be advised you had one.

 

The good news was it was due to drop off his file in a years time,

so the advice from the forum was just to leave it as it was so close to 6 years,

 

if we were to investigate it or complain it could be reissued and the 6 year time span would start all over again.

 

On the credit file it did not indicate who it was who applied for it only the court it was issued from and a case number.

We assumed it was BC as it was a Northampton court.

 

As I am nervous that HFO are going to try and start legal proceedings on this debt this week I did some research into the CCJ

- it turns out it was for the BC but applied by Moorcroft.

 

Think they are BC inhouse collections agency? My understanding is that a CCJ can not be issued twice on the same debt, but legal action can be taken to enforce the debt.

 

Also just to confirm it is not status barred as we did make a few of minimum payments about 3 years ago.

 

My question are?

 

How do we respond to HFO?

As far as we are concerned we are not refusing to pay the debt but will not acknowledge it until they prove the debt exists.

A completed application form does not prove anything - just that he applied for the card.

 

Do we advise them that a CCJ has already been issued against this debt?

Wouldn't a CCA have been needed 6 years ago to request a CCJ?

 

We really need to get somehting off to HFO but I am not sure what the best course of action is, especially without shooting ourselves in the foot about the CCJ.

 

 

All help and advice on this one would be grately appreciated.

First of all I would check the original Barclaycard default date as HFO are known to register there own when they take over the debt. When they are informed of this, its the normal response of "an administration error".

 

You can only be CCJ'd once for any debt, if this CCJ is to be re-registered they have to go back to court to do so, and I do not know of one case where this has happened.

 

HFO are full of it and love to send silly letter which hold no weight, so don't worry to much.

I will scan up the application form this evening and t&c's - the application form was very basic - mainly just his details ans signature,

the t&c's were separate and not signed - I will put it up this evening.

 

The account was opened around 2000 and defaulted and passed to collections agency in 2004. A few letters were sent but never any details of a CCJ issued. It has been passed from different collections agencies over the years - but seems safely (not) in the hands of HFO now. Huge amount of interest and charges have been added and keeps rising.

 

The default date has dropped off his credit file now as it was over 6 years ago so not sure who added it.

Does this help at all - is there anything else you need to help? The application form really is just all his details and signature - not an agreement.

 

But I promise I will post it up.

When are HFO supposed to have bought this? Have you had a notice of assignment? When did they first contact you?

 

Could the CCJ be for another card? It’s unlikely to have been sold on by BC with a CCJ attached. Have you checked The Registry Trust to see if a CCJ is registered against you? How do you know Moorcroft have a CCJ against you, and why do you think it’s for the same account? Are you confusing a CCJ with a default? Anyway, CCJs don’t just ‘drop off’ – the original default may disappear, but the CCJ does not. And I can’t see any thread you have about having a CCJ.

 

There’s some things not adding up here, and before you can be given useful advice we need a lot more detail. Please try and stick to one thread!
