      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

You can contact Northampton CC about the CCJ if you have the original Claim number for it - try and get the claim form and judgement sent to you, may cost a small fee. I also suspect that it is a different debt.

 

What exactly have HFO sent you that has spooked you? Have you received anything from Turnbull Rutherford? Please don't panic, as they say, but bit more info needed.

Ok Guys - number of questions have been asked - I have been through all the paper work etc again and I will try and answer the best I can. I have been trying to scan the application form and t&c's up but having technical probs at the moment. I will keep trying. Here goes.....

 

 

When are HFO supposed to have bought this? Have you had a notice of assignment? When did they first contact you?

 

The account was originally defaulted by Mercers in may 2004

 

We have kept pretty much all the paper work from DCA's, though there will probably be a few missing - we first heard from HFO and Turnbell's in 2006.

I can not find any notice of assignments.

We had a terrible time with them back then - offered to make min payments, and they were very insulting and derogatory about us and our personal circumstances.

 

 

Looking back now and knowing what we know now thanks to CAG we could of sued them because of some of the stuff they said to us. It just kept being passed back to HFO and their sols Turnbell Rutherfords.

 

Could the CCJ be for another card?

 

No the details of the CCJ given to us by the court was for Barclaycard

 

It’s unlikely to have been sold on by BC with a CCJ attached. Have you checked The Registry Trust to see if a CCJ is registered against you? How do you know Moorcroft have a CCJ against you, and why do you think it’s for the same account?

 

When we went back to check his credit file this year it was no longer on there

- when I say "dropped off" I mean it was no longer showing on his credit file.

 

 

We remembered which court it was - Northampton

- so he contacted them directly and they advised us to use the registry trust.

Which we did, but there was nothing on there about it, again I believe it was because it was over 6 years.

 

 

Fortunately we found an old copy of his credit report from last year which had the case number on.

He rang the court back up as we now had the case number and they emailed us the basic details.

If we wanted the POC them we would have to pay.

If we need to get a copy then that is not a problem.

 

The email advised that the claimant was R/O Barclaycard and the claimants representative was Moorcroft Debt Recovery.

 

I believe it is for the same account that HFO are pursuing as he has only had one Barclaycard and I can't see where else it could of come from.

 

Are you confusing a CCJ with a default? Anyway, CCJs don’t just ‘drop off’ – the original default may disappear, but the CCJ does not. And I can’t see any thread you have about having a CCJ.

 

The reason I believe it is a CCJ is due to the fact the credit file advises us that it is a judgement and give details of the court etc and from what the court have now advised us.

My understanding is that a CCJ would no longer be visable on your credit file after 6 years and I apologise for my incorrect terminology. The CCJ thread I was referring to is here

There’s some things not adding up here, and before you can be given useful advice we need a lot more detail. Please try and stick to one thread!

Apologies for the delay in updating my thread - life got in the way!

 

After sticking to my guns and holding fast Barclaycard repaid the charges in full including interest in restitution at 24.9%.

Brilliant result.

 

What is also interesting is that in the end they agreed to buy back the debt from the DCA and write it off.

I also refused to sign the confidentiality agreement, and they still refunded.

 

I hope this will encourage all people who are reclaiming their BC charges, especially those older than 6 years to stick to your guns.

CAG is an amazing place and people here will always be on hand to help.

 

I personally want to thank slick for his patience, encouragement and hard work.

It is because of people like him that make this site work.

He is totally amazing!!!

Good idea- lets people coming here for the first time, maybe desperate and dispirited, know that the Barclays monolith can be beaten.

 

Not just beaten, but crushed underfoot. :-D

 

Next thing you know, the new Cagger has done their SAR, sent a Letter Before Action and Barclays wake up one morning to find CAG tanks parked on their lawn!
