Private PCN with wrong date, do I send payment?

My son received a PCN from a Private Car Parking Enformcement Agency yesterday (06/9/07) its ticked as "unauthorised/restricted parking area" on ticket (residents parking bay) I assume the car park is private, but the Date of Issue and Incident is stated 06/08/07. Although I believe the ticket is invalid due to the wrong date and was writing a letter appealing against the date in question the ticket states that I must forward the £60 parking charge with my appeal within 14 days. Should I send the payment and payment slip or wait until I hear from the appeal?:???:

Call me stupid (as I have read most of the threads now)...but am I right in thinking that the ticket issued IS illegal whether the date is right or wrong and would it make any difference if I did just write and tell them that the date was wrong and the ticket is invalid anyway. Or can I just ignore it and will never hear from them again!:rolleyes:

I would suggest that you are right to think that it is highly likely that the ticket is unlawful. I think that you are on fairly safe grounds that the ticket cannot be enforced and key to this will be proof that the date of parking and the date of issue and incident are different (among other things).

 

For the time being do nothing. I would not be surprised if you hear from them again. If and when you do, the first thing to do is to ask for the identity and proof of identity of the driver so you know where to direct their enquiry and say nothing else. Then come back here for more advice and support.
