HBOS did not reply?!! URGENT

Hi just a quick question.

My mum had her return date yesterday (Hamilton Sherriff Court) for a small claim, but when she called the court this morn, they said that HBOS hadn't got back to them at all yest.

 

Can anyone tell me where she stands now, does this mean she has won?

 

What should she do now?

Hi, Area1.

 

HBOS did exactly the same thing with me, and I won. If there has been no response by the defender and you wish to minute for decree as craved complete Form 11 and send this back to the court. You will not have to appear in court. The minute must be received by the court no later than 4pm on the Friday before the Preliminary Hearing Date.

 

I went along to Edinburgh Sheriff Court with my paperwork and got the clerk to fill it out for me. I was told the Bank can still reply to the court, but very few do after the return date. The court will send you the Decree.

Tes she has won by default now she has to send page 11 the minit page informing the court wht she is sueing for eg the amount on the original papers plus court costs ( what she has paid) anything paid to sheriff officers plus 8% from filing date. The folks at the court cna fill you in on what is needed ot has to be in before the calling date. Best of luck:)

Thanks..you say this should be returned the Friday before the Prelim hearing...her hearing is scheduled for next Thurs. :o

 

Does this mean we should file the minute before 4pm today...

That's what it says on the court papers. You should give the court

a phone and ask them what to do asap.
