I sent my CCA away to paragon and this is what i have received today, now what do i do???

 

 

Dear Mrs Wilkins

 

I have taken advice on your letter received into this office on 30 August 2007. There is no obligation on us to produce a copy of the actual agreement.

 

Section 77, of the CCA imposes an obligation to supply a 'copy of the executed agreement'. Section 180 of the Act provides for the making of regulations governing the form and content of copy agreements and, pursuant to that section, the Consumer Credit (cancellation notices and copies of documents) REgulations were introduced in 1983.

 

Regulation 3 (2) expressly provides a copy need not be an exact copy of the agreement signed, in that we are permitted to exclude from the copy:-

 

a)

In short we have to provide a true copy of the financial particulars included in the agreement but not the actual agreement signed by you.

It remains unenforceable through the courts without the original signed Agreement.... I'm sure they're aware of this.... but are hoping that you're not.

I do not acknowledge any debt to your company.

 

I have noted your comments about the Consumer Credit (Cancellation Notices and Copy Documents) Regulations 1983. However, without sight of the original Agreement, I remain unable to confirm the precise Terms and Conditions that I allegedly signed and as such, any hypothetical Agreement that you intended to produce as part of court proceedings would be rendered legally unenforceable.

so if i send this off now, should they respond??

when taking to court, will i address evrything,

ie, no CCA with signature on, removal of CCJ, claim back bank charges etc, or if this is taken to court, could i get everything back i have paid??

After the 30th, you can withhold payments! After a further 30 days they have committed an 'offence'.

 

You can carry on witholding payments until they produce the CCA & they have no legal recourse! They can 'politely' as you for payment....but equally you can tell them to shove their heads where the 'sun don't shine'!:D

Sorry to bring this back to the top again. But I'd like to hear how Wilkinss208 is getting on.

 

I sent for my copy of the CCA from Paragon and received back a standard CCA with my name and address added, but no signature. They also sent a supposed copy of the application form for credit, but only some of it has my handwriting (my address). The rest is filled in with different handwriting.

 

I'm currently paying £225 a month to Paragon and still have not even started to pay off the interest they have added. I managed to get a statement from them which showed my account balance at £4000 when they took over Universal Credit. Since then I have paid over £13,000 and still owe over £12,000. It seems I make my payement and the following day they add interest equal or often greater than my payment.

As far as the CCA is concerned, you just keep waiting...

 

An important question though... do you have a CCJ on this account?

 

If you do, requesting a CCA is closing the door after the horse has gone, and you need to look in other directions.

yes i have ccj from 2004

there are lots of bank charges i could claim, then ask for ccj to be set aside as amount was wrong.

which option would be best
