    • Thank you again. I'm hoping it will come out in the wash and will endeavour to check my online account. I'm a bit unsettled by not hearing from Booking.com but the host is sounding helpful at the moment. HB
    • I've just remembered that a friend of mine had bookings cancelled on Booking.com about a month ago - and the good news is that all worked out in the wash. I'm at work now but will scribble properly in a couple of hours with the full tale.

    • Their FAQs state - Cancellations and modifications If your booking has been cancelled, Booking.com refunds you immediately. The processing time may take 7 to 10 days and depends on your bank. If you have questions, contact your bank directly. I'm a regular Booking.com and AirBnB user.  The former have never cancelled.  The latter have and my money was refunded immediately (not that that helps you as we're not talking about AirBnB!) Best to check with your bank and see (a) if you did pay in advance and (b) if it has been refunded. Also, have you received a message from Booking.com officially stating the cancellation?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I was so sick of all the bank charges so far over the last 14 months i have been charged £2,217 and after reading all the help and information on this site. I have sent the first letter of to them (recorded Del) with all the charges that they have charged me over the last 14 months. that was on the 14 June 2006 so just have to wait and see if i get a positive reply back from them.

Oh Libby, like many others you have been part of the game. remember your bank charges are a little tip which is gathered over the months for the shareholders bubbly.

 

i am still awaiting my bank statements. I have my sights set on a ski trip when all this comes through.

On the 25th october I will be filing a claim for £175.00 Citicards. Just watch it!

:( Tell me about it i was kind of lucky cause i bank online so i have all the charges and my statements online but the only problem is, that after two years the letters get deleted. took some photocopying i can tell you there is about 32 letters from the bank.

I got a letter dated 21 June to say that that they are sorry to learn of your concerns regardinging charges on your account.

 

we are keen to deal with your concerns quickly. A customer Relations Manager will investigate, then something like will contact you with a reply no later than 4 weeks.

 

i will of course not be waiting that long i wll stick to my timetable and send the LBA on the 3 July.

 

I have now encouraged at few more people to join this site.

Recieved a phone call from Halifax but i was at work, and this morning i recieved a letter from Halifax to refund all of the charges for 2006 for £468.00.

 

What is the best course of action i think there is a template but can't seem to find it!! :???: :???:

:o Can i just ask anyone, i am supposed to send the LBA on the 3rd of July but they offered me £468.00. Will i amend the first paragraph to something like i accept their offer, but advising them that I am intending to reclaim the full amount of charges. not sure how to word it can anyone help please.

:( Right Guys i am getting worried i have to post the LBA on Monday 3 July 2006, I am not sure if i am worried in case i have to go to court, general does the bank not go to court and bottle before it gets that far.

 

Can someone please post back and give me some confidence cause i need some. LOL not.

:roll: Thank you that has given me some confidence, so generally they get in touch with you before it goes to court. but in all cases halifax close your account. is that right.

:mad: :mad: I have come home to find my mum in tears ( she too is with Halifax) i wish she told me before but she is in a state over Halifax, they have been charging her nearly 3 chrages for month and it has a knock on effect so that each standing order will not go out, i am at a loss of how to help her, she knows that the charges only started about a year ago. so i have been really sneaky but i E-mailed Halifax to ask if there is a chance that she could have statements for the last 12 months as she would like to prove to a company if she had paid them, not sure it will work but as we are both skint and i can't afford to pay for my daughters dinner money at school ( having to make her packed lunch) have no choice at the moment. if it does not work i will wait till i am paid then send of the 10 pounds and go from there!!!!! :mad: :mad:

 

god this is terrible

i have now opened a new account for both of us at natwest.

 

sorry to go on abit but mum was so upset, and i am sooo angry at HALIFAX.:mad:

I am sending my LBA letter off tomorrow and sending a Prem letter of for my mum which is for £240.00 thats only for the last 8 months, so hopefully i can get her money back for her.

 

I have found out that i may get reduced court fee's because i get tax credits and have a low income, so i am going to go to court and ask them.

i think that i am getting the hang of this, but need some more help i want to get the claim form ready, i know there is help on the temps page but is there a sample of the claim form like some kind of temp so i could get an idea, i know i am not legal minded. very grateful for any help you can give me.

In the templates section there is a guide to completing the Particulars of Claim for an N1 form.

 

You will also need to fill in form EX160 to apply for exemption for court fees.

Hi i thought i would give you an up date still no response after sending my LBA, but my mum recieved a standard letter from her Prem Letter. I need to send my Claim form on the 17 July i hope they send a reply before then.
