I have fell behind with my water bill. I had a phone call to ask for a payment. I said I could pay £50 and asked them for a Giro slip to be sent out. I got told ok and the call ended.

 

Today I just got in the post a letter from a county court saying I owe this much. I rang up Severn Trent and hey said I never made a payment. I said I never got a Giro slip like requested. They said well its to late now.

 

Now I can either Send in a admission but get a CCJ, send in the admission with a date of when I can pay in full or a defense.

 

Any advice people?

Yes, pay up, then say to the court you have paid up, claim ends, no CCJ, yes, you now have the court fee to pay as well, but next time, you'll remember to chase up the Giro slip. Not having received it won't stand up as a defence, you knew you owed the money, so the responsability of paying lies with you.
