Hiya Hollyjake, welcome to the HSBC forum :)

 

As MTM says a new bank account may be the answer if HSBC cant keep their hands off your money, also you say you are living on govenment benifits, the bank should not be taking any charges out of this money at all here are a couple more threads for you which deal with this.

Thanks for that, I have just last week sent a lba to Hsbc, and headed it hardship case, I emailed it first and sent the hardcopy in post, I am wondering how long they will take to respond, due to bank charges I was forced into the managed loan in August, but with a lot of my charges my bank has admitted a lot of service and administration errors, so I am hoping to put the pressure on them, I have told them in my letter, if they do not consider my claim and generally fob me off, will ake my case forward to the fsa and fos, highlightenig all their mistakes, and that if I have to seek this action then I will claim compensation too, this month have not been able to pay my manage loan payment of 50.00, so they have charged me 25.00, I will be paying my loan within the next 7 days, I have noticed hsbc have been trying to contact me I bet its about the loan not my letter, but will keep you posted on the issue

But recently lost my property, due to repossesion in dec, I have a few debts to star sorting out, but the council are a pain, they arewanting to make me pay for my property which has been repossesed, I moved out of this property in Aug, coucil dont believe me even though I have showed official document to them, they have taken attachmnt of earnigs from my partners wage, even thought the debt owed is wrong, they took out 300.00 out of my partners wage for my old property, and expect me to find more money to pay for my new proprty.

Everything is just carving in at the moment, and its hard t deal with everything at once

Hi Holly. What are the council asking you to pay for regarding you old property? I presume it is council tax they are asking for.

If the property has been re-possessed then it no longer belongs to you and you are not liable for ongoing expenses. Is it council tax arrears that they are asking for?

We need to try and break down your problems and deal with them individually!

Theh council are wanting arrears for from April 07- Aug 18th 07, and a 50% reduction on the balance from Aug 18th 07 - 31st March 08.

 

The reason I got into arrears due to the suspended possesion order on my property, I was concentrating paying my mortgage payments + arrears towards mortgage, which left us no money at all, as I have been on incapacity benefit and disability, I do normally work, and due to all the problems with Gmac, mortgage provider, being nasty, and getting things wrong all the time i ended up having a breakdown too.

The second charge secured loan went for repo on 19th July, we was meant to be out on this date, but financial adviser bought us extra time, so that she could look for a loan or mortgage, when extra finance was unavialable, and I did not want to get into a downward spiral of debt anymore, I deceided to put property up for sale and move out, I stopped in august paying my mortgage to Gmac my first charge

2 days before I was due to move out, the council baliffs came, 2 of them, started threatening me infront of my children, and were quite forcefull, they barged there way into property, 1 of them wandered round my house while the other one kept an eye on me and my kids in kitchen.

I told them we were not liable for all amount, and that I was moving, and that the property was not mine, they took no notice, and force me to pay £100.00 there and then by chq, they also told me that they would come after me if chq bounced,and told me that they would come back in 28 days for the rest, they kept asking me my new address, I would not give it them, they said they would find me, they was hardly any furniture in property as I was moving, as soon as I moved, I wrote 2 letters to baliff, 1 on 30th aug, and again on 10th sept, so that the dept be returned to council, the council would not speak to me or listen, and said whilst my debt was with baliffs they would not communicate, the baliffs took no notice of my letters, and kept sending letters seeking the all amount,

The baliffs refered the debt back to council on 5th nov, and they sent a visiting officer to my old property on 13/11/07, and noted down the property was empty and no furniture, and up for sale, the proceede to court for attachment order off my partners wage, this was done on 22nd nov, they did not let us know, they had no contact with us, this info I only found out after the had taken the money off partners wage on 15/12/07 to the tune of 300.00, the attachment of earnings from the court the got was for the wrong amount of £1097.00 arrears,aril 07 - aug 07, and 50% discount till march o8, as soon as the money came out of my hubbies wage on 15/12/07, my hubbie over last month had worked every hour he could get at work so we could get straight

Rang council on 15/12/07, and the told me I had to make an appointment went on 20/12/07, basically told me my official court documents for eviction and possesion were not good enough, told me the order would sty in place took photo copies of my evidence, I got myself so upset about not affording my new property tax, which that bill was calculated for 1st payment in Nov, which I am unable to pay due to attachment order, they told me I had to pay that as well, they threatened me with baliffs, I just broke down and cried at that office, they said someone would call me back, that did not happen.

Yesterday I wrote a letter to them, stated all the facts dates times and photo copies of evidence, I have told them I am sending a letter to court to inform the court, and send a copy of my letter to the court, I posted this today to the council, I was pretty harsh in my letter, I have told them I am going to my mp, and report them, I have asked for there complaints procedure and ombudsman who they use.

At 12pm today, I get a call from them, I explain I just sent the letter to them, she told me the attachment order will stay in place, I told her this is wrong, they have not sent me a new bill with adjustment, just that she will be sending me an income and expediture form, for us to fill in, so I will see what happens, but I am so frightened they are going to take my benefit too.

Sorry for being so long, I also received a reply from Hsbc about my Lba hardship case, I only sent on 27/12/07, their letter dated 31/12/07, but dated to my old property address, strange can they not get any thing right, they are willing to look at my case, I will post extracts of letter on here later.

I have just received a letter back from Hsbc to my LBA financial hardship, I only emailed this to them on 27/12/07

 

Thank you for your letter dated 27th december 2007

 

You have mentioned that you are presently suffering financial difficulties and we are sorry to hear that.

We would like to help by carrying out a review of your individual circumstances with you, and as part of the review we will be able to verify that you are suffering financial hardship

 

Subject to that verification, we will explore with you what we may be able to do to assist.

 

This will include considering whether some or all of any current debt could be rescheduled or whether alternate borrowing arrangements could be put in place. The fact that you have incurred overdraft charges and are claiming a refund of those charges will form part of our overall assesment of your circumstances(as will all other relevant factors) but our focus will be on considering what we may be able to do to assist you, not solely considering refunding charges as you have requested.

 

Enclosed is our putting your finances in order leaflet, this contains an income and expediture form which if you like to speak to us about your circumstances, we will need you to complete. this is required as our records will not always contain your full financial picture .

 

Once you have completed the income and expediture form please contact us on 0845 600 6423.

hiya holly, thats hsbc's standard reply to a hardship request and tee's you up for another managed loan.

 

as mtm and I said when you first started posting you would do well to open another bank account and just leave this one with your claim against it untill the test case is sorted out.

Hiya holly, you seem to have a lot of related things that need sorting out which we arn't achieving by looking at one bit at a time here.

 

I don't know if you have done this yet but I think you should go and see your local citizens advice bureau to get yourself back on track, they have specialists who can look at your whole situation and help you with things like your council tax and your managed loan and work out what and how much you have to pay.

 

from what you have said about your council tax I think you must have some sort of county or magistrates court judgment against you which will need looking at in detail to either get set aside or to enable you to comply with the courts directions.

 

When you go to see them take all of the relevant documents with you so they get a complete picture of your situation and can advise you on a complete way forward.
