    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am looking now thanks McIvelli (oh i wish i could do a Prince of Lies on them). My only thought is that i intended to reply to there letter (as it took them only 3 days to say no) to answer there reply about service charges themselves.

Or do i leave it to the 14 day deadline and send the next reply saying you have another 14 days to reconsider or i take you to court?

much in confusion

Hi again Van,

If there is one piece of advice running through every thread on here it is:

"Don't panic & YOU set the agenda / timescale, NOT the bank"

It's almost certain that the letter is a standard "fob off" designed to discourage you & has been sent to everyone in here at the start of their claims.

I gather you've:

1) Got a list of your charges AND statements for the past 6 yrs

2) worked out your schedule of charges

2) Sent off your preliminary approach for repayment including your schedule

You need to wait 14 days from your preliminary approach letter & send off your letter before action.

You'll find the templates here:

All The best

Oh I should've added: Do send your letters by recorded delivery.

There are a few opinions as to where it's best to send your preliminary & LBA (letter before action) letters. Many advocate sending your letters to LTSB's customer "care" centre in Birmingham (full address in the link below)

http://www.consumeractiongroup.co.uk/forum/lloyds-bank/236-lloyds-tsb-contact-details.html.

Some send their letters to:

Customer Service Recovery Centre

Charlton Place

Andover,

Hampshire

SP10 1RE.

After sending my LBA to Andover & it still being "undelivered" after a week,

I actually re- sent mine to my local branch where I got a signature!

I suspect Andover is rather like a certain address in Lapland in early December & they are obviously receiving so many Prelim' & LBA's that the poor old postie dumps sackfulls of mail in their reception & they make 1 signature for the lot!

In my honest opinion, I believe that the proof of posting element is the most important thing, as LTSB usually don't seem to enter into any meaningful dialogue until you slap a court case on their laps anyway.

Keep me posted (groan) & I'll keep an eye on your thread :)

1) i have the list of charges that they sent to me, I did not ask for the statements as i thought it would be sufficient to go with just the list

2) Yep i have that saved in 4 places so far.

3) yep again i sent them my letter from this forum as well as my statement, i have also worked out the interest to allow me to have something to "trade" if we could work something out.

However due to having to move from Kent to Brum, i might have to deal it to the middle of August, and it looks like i will have to request my bank statements to have incase i go to court?

thanks for help
