I wasn't paying them any payments anyway :oops::lol: Forgive me for being dumb but after the 20th Aug (the extra month on top) and not heard anything is this then classified as done and dusted?.. Won?

 

Or, if I hear anything do I threaten stuff for them not sticking to the 12 business day agreement since they failed to stick to that! Although we will cross that bridge when it gets here, just hoping it doesn't now.

 

P.S. I was right about the delivery date being the 4th. Just checked the signed for and it was the 4th :) So 20th is definitely the day they should of replied at the latest.

Welll if they don't reply after the 12+month AND start demanding money while in default, a report to Trading standards would be in order.

Until the produce the CCA this debt is in default and unenforceable.

Just an update. 20th Aug been and gone and absolutely nothing from CrapQuest at all. Is this normal of CapQuest? I've never dealt with them before what-so-ever.

This is quite ormal for most DCA's when they don't have a leg to stand on ;)
LOL :lol: So they will just close the case their end then and not write back? Or will they leave it a while and then start sh*t up again pretending like they've never heard from me.

 

I'm a little confused as I don't know where I stand. It still feels like I have weights on my shoulders. I don't feel free from them which is what is making me feel this way. I'm worried about buying things (we're saving for home improvements) yet feeling a little scared about spending money on home improvements as as soon as we do we'll probably curse ourselves.

 

We're trying to clear our other debts too and nearly there. Do we still class this as a debt to save up for to pay off or not? Argghh I'm so confused. And such a worrier. :oops:

Bumping this up as you can see they failed to provide me with my CCA when I wrote to them ages ago back in JUNE... yes June.

 

Well guess what? I was doing my banking budgetting today and they've taken the £1 cheque. I know I should of cancelled the cheque but I forgot. It seems silly to demand my £1 back since it would cost me more than that to write the letter :lol:

 

Shall I report them for failing to provide my CCA in that time and then unlawfully cashing the cheque after the legal time limit?

Keep a record of the fact they have banked the cheque as this will work wonders when/if another DCA comes knocking for the same debt.

Thanks to CapQuest you "debt" is now unenforceablely in dispute.

Thanks for helping me so much, it is really appreciated.

 

Ignore my stupidity and ignorance in this as I'm new to this all really but is it good that they've cashed it? Am I supposed to be receiving this CCA within 12 days that they've cashed it now in the legal eyes?

 

Is there any time that passes by where they cannot legally chase me for this debt and I can consider that I don't owe it anymore? *blush*

After 12 WORKING days the "debt" is in default and stays that way until the request is complied with.

If a FURTHER month passes then the DCA has committed a summary criminal offence and the matter should be referred to Trading Standards for action.

Bear in mind this DOESN'T void or cancel the debt, it still exists, but is unenforceable.
