    • Its okay - It happens. And this is why DCAs  user every trick in the book to try and make you crack.  Now its time to come back.    Im not sure how to proceed if Im honest if they have issued a Letter Of Claim.  Only as You could complain to Oakbrook and they still proceed with Legal Proceedings, but I dont know if that would help or hinder the legal proceedings if they began down that avenue.  I know a FOS complaint wouldnt stop Legal Action and probably run along side it.  But I guess a judge would view a disputed balance with the original creditor as cause for concern whether the DCA's claim is valid?    A bit of a muddle.
    • That is superb. To answer your question - Dear Mr Dhaliwal Change the sentence - As our disabilities were ignored and disregarded for the time taken I believe this is discrimination against us ... To - As our disabilities were ignored and disregarded for the time taken I believe this is discrimination against us contrary to the Equality Act 2010. Iceland have always been useless, not only in your case but in others, but I think if they realise they are breaking the law it will encourage them to act. I also think the letter is overlong and you could lose the paragraph - I cannot afford any unfair charges of this kind as I am severely struggling financially. I cannot work and am a carer for my disabled Son who also has a mental and mobility disability. I obviously do not have any disposable income and am in debt with my bills. So its an absolute impossibility for me to pay this incorrect charge - as the main points are made elsewhere.

    • I want to add my 2 cents here...  The purchase of this debt, Perch Group dont absolve themselves of liabilities from the Original Creditor. They should be responsible for dealing with this complaint in response to an Irresponsible Lending dispute.  If the balance is disputed as such in that way - Then they should be referring to the Original Creditor where applicable.    Also if your complaint was written in a way where a template wasnt used or it was rewritten to a similar effect where it wasnt recognisable - Then you probably would have stood a better opportunity at it not getting rebuffed.  To be honest those - Perch and TM Legal are a waste of Oxygen and will say anything to get you to pay.    Ditto on the template. Where did you find it?  Please keep in mind we have to unravel what you have done till now and help build a formal response.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

I'm a little bit lost with all of this, my claim from Marbles went through very easily with minimal haggling and the full amount repayed. But MBNA are a whole different kettle of fish!

I've read up on a lot of the threads regarding MBNA (including the legendary Battleaxe saga!) and am unsure where I should go next..

I sent the orignal SAR off 17/03/2007

Recieved partial information back on the 4th May (only back to 2003) with letter saying they didn't treat it as a SAR etc. etc. and offering £390 goodwill.

Sent copy of drivers liscence and their comleted form back 10th May stating that they had not complied and giving them a further 10 days to (1 recorded delivery & one standard delivery :) just to be sure).

Sent another letter 25th May saying that extending their deadline again by 7 days (am I being too leanient??).

Recieved a letter 16th June, with the same set of statements and offering a further £662 (calculated claim as £976 so their offering more.) includes the line: "In regards to your SAR, we are currently dealing with this and your requested information will follow".

I have a couple of questions though:

I know I have been completely c##p at handling this account, but the minimum payment goes out of my account every month by direct debit. Invariably I recieve a monthly letter stating that the amount has not been recieved etc... I have not had an A & L card for at least 2 years (they stopped sending them) and there have been no purchases on the account since 2003 (still a whopping great balance though!)

What should I do next?

Should I just accept the offer and have done, or should I enquire about my CCA as I know for a fact that I have never signed a credit agreement with MBNA! or recieved anything with my new cards (as I haven't had any for at least 2 years.)

Help please.:?

Just had a conversation with James Docherty ( 01244-672628 ) regarding my S.A.R (initially sent in March, and followed up with ID and a filled in form in May recieved by them may 14th). they've sent info back to march 2003 (account was opened in 2001).

What he had to say was quite interesting, if you mention that you are intending to claim back the fees in your letters they will treat it as a complaint and instead of sending out the complete requested data will generally make goodwill offers instead.

I pointed out that they are required to supply the information under the data protection act, and he just repeated the same thing...they treat it as a complaint etc etc. and that he'd speak to someone to get the information sent out!

is this a new tactic??

I've been trying to work out contractural interest on this card but don't have the balances as they just send a printout of transactions. Is there any way to do it without the balances? Shall I just add 29.9% everyday from the day the charge was made:-|

pabtyf,

They are in breach of your request, but I do not know if the breach comes into effect if they have cashed your £10 payment or not (may another person can confirm this)

Youll need the information from a SAR as it tells you all the information you need, as in interest rates at the time, which might be why they just gave you a print out of the account transactions.

That's what I thought :( So what do I do next? I've sent of a CCA request today, it'll be interesting to see if that turns up

Hi Pabtyf, I'm not sure I'd give them any leaway at all. All I got was a list of dates and fees from them after my SAR request (which was all I asked for). My hubby phoned MBNA because we wanted to know the interest rate they charged . It turned out we were on 24.9% from the very first late fee we ever got. I might be tempted to estimate the charges, claim 24.9% (or whatever you think your rate is) and send the LBA. It's then their job to prove otherwise. Good luck, Dizzy :D

  • 3 weeks later...

Update: Finally recieved my full S.A.R - (Subject Access Request) today (including my £10 cheque). Unfortunately it also contains my original CCA so no line there:( .

I called them today to say that I'm not happy with their current offer, apparently the Defalt Charges team are no longer taking negotiation calls and you have to put it in writing (I was going to anyway) and send it to:

Default Charges Team

Customer Advocates Office

MBNA Europe Bank Limited

PO BOX 1004

Chester Business Park

Chester

CH4 9WW

(Not sure if that's a new address).

Anyways I think I have calculated my interest now (£672.92 not sure if it's right but it's enough:) ) so I'll send them my initial claim and see how it goes.

Good luck Pabtyf, you will get there in the end.

I ve just received all my charges plus contractual interest off them today.

They kept sending offers and I kept sending rejection letters until I had the full amount. I had four offers altogether.

Penny.
