hi i need help in writing a letter to d&g, i've got my statement of charges together to send to them, and i've just had notification that the court has dispersed with AQ, but i dont know how to word a letter to them can anyone help.

I found this ,,, hope its of use..

 

Once you have filed your claim, you need to send 2 copies of your schedule of charges, clearly marked with your claim no. + a brief covering letter asking for them to be filed with your claim to:

 

 

 

The Court Manager,

Money Claim Online

Northampton County Court

21-27 St. Katharine's Street

Northampton

NN1 2LH

 

Dear Sir/Madam

 

(Your Name) –v- (Bank)

Claim No: ********

Date Issued: xx/xx/xx

 

Please find enclosed a schedule of penalty charges taken from me by the defendant, along with interest claimed at the annual rate of 8% pursuant to section 69 of the County Court Act. The interest in addition to the amount in charges equates to the total amount of my claim, namely £(AMOUNT).

 

I respectfully request that the enclosed schedule should be attached to the particulars of my claim.

 

Yours sincerely,

 

 

 

 

Wait until you receive the Notice of Acknowledgement (not the Notice of Issue) from the court and then send a copy to the bank’s solicitors, since they are the ones who will now be dealing with your claim

DG's details will be on page 2 of the acknowl.

I understand you have a policy of initially rejecting claims for overdraft interest. However, should this be the case after you have reviewed my claim, you should be aware that my claim for overdraft interest has been meticulously calculated and double checked. It only ever relates to the cumulative charges within the overdrawn balance of the account at the point that the overdraft interest was debited

 

If it is that in your view the interest is not claimable, I am prepared to discuss this with yourseves and the judge in court.

DG will most likely file their defence on or just before the 28 days. Then you'll get transferred to your local court. Then the nudges begin.

 

So get the two letters off & then its a matter of sitting out the 28 days.

Hi Jenny, once your case has been transfered to your local court you will receive papers from them stating what the judge has decided regarding the aq. Even if it is not required you should still ring the court to see if the allocation fee is still payable. Some courts are still asking for it even when the aq is not required. You can add this fee to your claim.

You need to read this New---after 28 Days - Maybe No Aq!!!!!!!!

thankyou for your responses, firstly i am not cllaiming interest as this would have taken me well over my £5000 and the wouldnt have been able to go through small claims, secondy i have recieved my transfer and you are right no AQ is required will phone court tommorow to see if i need to pay a fee though. My worry is is that its at the hull county court with dj murdock and i'm sure he is the one who has been throwing cases out in the banks favour. can you let me know what i should put in a nudge letter i know im a bit thick but im not very good at all this and im getting a bit dismayed

It has come to my attention that as of xx.xx.xx the filing of an allocated questionnaire may not be required in this case.

 

I am aware that you have a vast number of claims with which you are currently dealing with, and in order to resolve this matter more quickly, I am willing to accept the sum of £xxx.xx in full and final settlement. Please note that I do not agree to waive my rights in respect of any other actions, nor do I agree to a clause of confidentiality.

 

I hope to hear from you very soon so that a reasonable conclusion to this claim might be achieved. I am sure that the courts would approve of our settling this matter in a timely manner and without their further intervention.

 

I have again enclosed a copy of the schedule of charges. This schedule also shows the total of my claim to date, being the original claim amount (£xxxx.xx), the daily interest total to date (£xx.xx) and the court fee (£xxx.xx).

Are you sure i cant put in the face it looked ssoooo good, ok maybe not thanks for the info though im writing my letter now am a bit behind am only just sending my statement of charges hope this wont hinder case
