:-) Wonder if any one can help. I sent £1 to RBS to them to produce a copy of my personal loan agreement,under the Credit Act 1974, they have duly obliged within 12 dys but it's not dated or even signed by me or my husband is this legally binding or do they have to produce somthing dated and signed. It was for a personal unsecured bank loan.

in regard to the request for info under s77-78 of the act they have probably met their requirements under the right to information. as far as enforceability is concerned it wouldn't be although they haven't proven to you at this stage that they have or don't have a copy of your actual agreement. you could consider SARing them?

You may also wish to consider scanning and posting the copy of the agreement they sent you (remove all personal info first) as it may not comply with the CCA1974 and would therefore be unenforcable even if they do have an executed agreement somewhere.
