i've sent a DPA request for the past 6 years info from my credit card company (capital one) and they've sent the last year and a letter saying that as the preceeding years are now archived on microfiche they do not have to comply and want £10 per statement (ie £120 per years worth of data)

does anyone know whether this is correct ? can i force them to supply the data ?

It is incorrect they have to supply it . there is a LBA for non compliance in the libary

If they've put it in writing that they're not willing to supply ALL of the details, then lodge a complaint about them with the Information Commissioner's Office.

Worked for me when the Clydesdale Bank tried this trick.

I have successfully claimed against: "MBNA, Capital One, Bank of Scotland & Clydesdale Bank"

I got my statments on saturday and these were copies of actual statements. They went back to Feb 05 which is when i opened the account, i also got a copy of the credit agreement so they cant be on microfich. Did you send your request under a DPA heading and pay the £10?

If so then they are fobbing you off cos myself and others have recieved a pretty comprehensive pile of info. You could write back and say that you have evidence of this and you will report them without delay.

Good luck with your claim.
