    • My wife is the named person to his bank account with him having Dementia being his daughter (I say named person she still is but he recently passed away and the deputyship application has now being stopped by the solicitor as it's no longer needed) We've only just got the Death Certificate so the bank will be the next step informing them. She went to the bank and explained the situation but even being his named person the bank said she didn't have the power to stop DD without any legal documents (virgin money) was the bank. She could have copies of bank statements that was about it.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

 

D-Day for the AQ today - not getting my hopes up though. Expect they have submitted asking for a stay. :mad:

 

I will call the Court tomorrow - god I hope it's not a saga like last time!!

Hi all

 

Well.........................

 

No paperwork from the defendant has been logged on my file as of 10 am this morning.

 

File going to the Judge tomorrow - the Court clerk says it is "highly unlikely" that the Judge will order a stay if Abbeys' AQ has not been received.

 

The clerk is going to call me later this afternoon to confirm if AQ definately not received.

 

Not celebrating yet - as we all know it can still go Pete Tong even after the deadline, but here's hoping!!

Well thats the info I got from the Court this morning, so we will have to wait and see. I really think it is down to individual Judges as to what happens; to be honest I wish they were ALL singing from the same hymn sheet. At least that would put paid to the current "lottery" system with claims around the country.

 

I will update when I know more - everything crossed for you on those judgements.

Hi all

 

Lee, I actually meant that I hoped the Judges would have seen sense and processed all claims already in the system before the announcement. But no such luck - I sincerely believe that there will be a blanket stay announced very soon, as indicated below. :mad:

 

Anyway, update is..........no update! No phone call from the Court clerk this afternoon, and I tried to call about 3:50 but couldn't get through. But who cares - chances are that even with no AQ the case will be pending indefinately.

 

I have read this a couple of times today, on Orders received by claimants:

 

The action will be stayed until 28 days after publication of the decision in the OFT V Abbey National test case filed in the High Court on 27 July 2007 to reduce the need and/or amount of litigation in these types of cases.

 

28 days after the decision?????????? OMG I could be drawing my old-age pension by then. And this is being ordered even in cases where the Defendant has failed to comply with directions.

 

I can't decide whether to think along the lines of:

 

I wish I had done this sooner, or

 

I wish I hadn't bothered, and saved myself £350 and a lot of hassle.

 

Trying, really trying, to stay positive, but my will to do this is deteriorating rapidly.

 

Oh well, 24 days till the start of the "Real" ;) World Cup - at least that is something good for me to look forward to!!!!

I understand exactly what you are saying Jo and TBH i am feeling the same myself, but there is nothing we can do if the judges wont allow the cases to proceed then thats put a halt on that, but we need to stay strong, it will happen just not for a while yet.

The money will come eventually i am sure of this

It seems most people are gonna forget about all this till the OFT ruling the forums are getting quieter and quieter :(

 

Chin up im sure we should get something if not all of it back, but cant help thinking this case is to big for even the high court!

Yes, thats what I was thinking too.

 

Trouble is, if we stop campaigning the banks will perceive a moral victory.

 

It is hard to keep going - it feels like we've all taken a major body blow.

 

The £350 I have shelled out so far would have covered crimbo pressies for the boys, and more; now I have got to find that money again, as we all have. That's what is really peeing me off.

 

But I shall stick with it. At least I can keep using my smileys then!! Did you get the PM re them, by the way?

My costs are now at £385, but had some good news off Gary H if the judge orders my CPR-18 Request they have to answer it even if they put a stay on it after! So hopes are up again!

 

Cant believe it will take til February 20th 2008 for a ruling!

 

Still we can just keep helping confused people :)

Hi All

 

Still no news from the Court!:mad: I have been ringing all day, but there is either no answer, or it's engaged. Guess they are inundated with people like me!

 

So I have sent an email to the Court, asking them to confirm if the defendant filed an AQ, and if a stay has been applied for, or granted by the Judge.

 

Watch this space.........!!

Yes it is only about 10 minutes walk - I did think about it, but my two slobby children are still in their PJ's and can't be bothered getting dressed!

 

But we have to go out tomorrow morning, so if I have heard nothing then I will be marching in there!! Won't get my knuckle-dusters past the metal detector though!!;)

you are a wicked mother lol, my 3 year old helped me to blitz the bathroom yesterday - he has no one to blame but himself, he has been brainwashed by blooming Barry Scott and so we bought CB, and he sprayed it all in the bath and the basin for me, he thoroughly enjoyed it, a bit too pink for my taste though :-)
