Think I have come to a plan dx please correct me if I am getting you wrong but I am going to go down the route you suggest. simply stop payments for now until I receive a DN and it gets marked on my file. Then contact each lender and start making token payments to each one. i then assume most like they will then at some point sell to DCA. Once they are sold I’ll be coming back to see how best I deal with it.  Let me know if I am making some error in judgment or missing anything with my plan

    • I googled "prescribed disability" to see where it is defined for the purposes of S.92. I found HMRC's definition, which included deafness. I don't  think anyone is saying deaf people cant drive, though! digging deeper,  Is it that “prescribed disability” (for the purposes of S.88 and S.92) is defined at: The Motor Vehicles (Driving Licences) Regulations 1999 WWW.LEGISLATION.GOV.UK These Regulations consolidate with amendments the Motor Vehicles (Driving Licences) Regulations 1996...   ….. and sleep apnoea / increased daytime sleepiness is NOT included there directly as a condition but only becomes prescribed under “liability to sudden attacks of disabling giddiness or fainting” (but falling asleep isn't fainting!), so it isn’t defined there as a “prescribed disability”  Yet, under S.92(2)(b) RTA 1988 “ any other disability likely to cause the driving of a vehicle by him in pursuance of a licence to be a source of danger to the public" So (IMHO) sleep apnea / daytime sleepiness MIGHT be a prescribed disability, but only if it causes likelihood of "driving being a source of danger to the public" : which is where meeting / not meeting the medical standard of fitness to drive comes into play?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

HI

 

Im in the process of claiming back bank charges from LLoyds but have encurred more i nthe process £150's worth. How do i go about getting them back, do i have to resend the 14day letter request again or is there another verson after winning in the past?

 

Also i want to claim for charges on my CC whcih i didnt realise you could. How do i go about do this. Im having trouble getting my statments they say i have to write in and get them, is this true? AS i know people have before and never received them?

 

If i started this after i have won which the charges im claiming now, is the procress a whole lot quicker or do i have to wait all this time again as they know i can win?

 

Hope someone can shed some light :D

You can claim all of your bank charges up to the point of filing your claim at court. If the 14 days has elapsed or if you have received a reply go ahead with your LBA. Attach to this a new Schedule with your most recent charges added.

Sorry, can't help with credit card as haven't done this yet.

Good morning,

 

Similar case to myself. It all dependends at which stage you are for your additional fees. If it is before the issue of the N1 just add them to your schedule but if not I waited and are claiming again. It costs them loads in court fees

 

The credit card you have to request and send a £10 fee (which subsequently they returned with my statements) letters can be found in the library with the instructions. Tried to send the link but with not being totally ofay failed miserably.

 

Id ake them all on at the same time

i have a court date for June and i know they will cave in before then, when they have do i just start the whole process again to get them back or is there an easier and quick way to do it?

 

Also some charges will not comeout until end of june i was told. If thats the case and i win my claim can i just go into the bank and ask them to stop them from going through?

thanks :) ill send that letter off to the address TSB gave me to get my visa CC charges back. and get that roling. I cant see why they wpould take longer or the same amount of time this time as they know you have won and will win again. If there is a MOD reading this, you able to shed some light :)

With the letter to send to get my credit card statments, do i send that letter posted above with a cheque for £10? It says 40 days to send them, can i actually change that as i was told on the phone it will take up to 14 days. 40 days is a long time!?!

 

Looking at that post, it seems they dont send them or take forever, cani go into my branch and request my CC statments?
