does anyone know the costs you have to pay for filling a court case for non compliance with the Data Protection Act? they have only partially complied and there is still heaps missing, i have the form all sorted out but need to know the fee ill have to include. ta.

 

ETA, i have read the form filling in notes and it states that the fee may be anythign form £30 to £150, how do i find the exact ammount?

me against the abbey Paid in full (donation made)

me against the woolwich Paid in full(donation made)

me against HSBC Paid in full(donation made)

thanks livelylad :) i thought it was either that or £150 but didnt want to put the info on the form ( and of course you cant save it and come back when they are open tomorrow) thanks for the speedy reply :)

lodged claim with Altrincham County Court for Natwest non compliance of SAR (been wating now 5 months !) enclosed cheque for £35.00

My claim was returned along with my cheque ! The Court sent me a booklet and they highlighted the section on fee's which states ' To issue proceedings where your claim is for something other than money the fee is £150.00 !

 

Is the fee £35.00 or £150.00 confused ?

HMCS leaflet EX50 says that for claims other than money the fee is £150

No idea. However, The Data Protection Act says

 

7. - (1) Subject to the following provisions of this section and to sections 8 and 9, an individual is entitled- …

© to have communicated to him in an intelligible form-

(i) the information constituting any personal data of which that individual is the data subject, and

(ii) any information available to the data controller as to the source of those data, and

 

This data is not intelligible. Write, quoting the above section of the DPA, and ask them what it means.

the leaflet states that if the claim is only for items other than money, i have asked for additional costs up to a value of £20, making the claim for money and information means its costing £30 at southampton county court HTH
