    • Right... Misuse of Facility is a Cat 6 and is considered the worst out of all of the CIFAS Categories for CIFAS Markers.  However lets see what happens when MCB come back to you. Make sure you refer it to the CEO.    IF YOU DONT HAVE A VALID REASON FOR THE ISSUE WITH PAYMENTS ETC - Then the marker will stay.

I can prove that I had to buy a new washing machine, I have my pay slips showing the emergency tax code and a letter from the tax office after I had spoken with them to get it corrected and of course I can get a copy of my vet bill. And all of this was in the first 2-3 months of 2024.  I panicked. Stupid I know and as you say, I have learned the hard way and I am not in any way denying anything that I have done wrong, but it just feels a bit unfair.  It is what it is I guess and if I have to have it on me forever then so be it. I am just so worried about the bank situation 😕

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi lang,

I havent ever had that letter but lots of people have.

I would say ignore it and carry on with your timescale...........I dont know how far you are with your claim though.

If you post details of what letters you've sent etc then someone can help you further. :)

I'm in the same boat as you, After the prelim letter date 4th May I got the same reply you got dated 11th May. This appears to be a standard letter to try to put you off progressing the claim. The second letter was sent yesterday declining their decision. So I'll wait and see what comes next.

Make sure all your latters are sent recorded delivery, and their delivery can be tracked. Stick to your time scales (14 days).

Okay thats the celebration out of the way, to answer your question, I'm not sure which rejection leter you got, whether its the first one or one of the subsequent ones you will get.

1. After the Prelim letter comes the "Our charges are legal" letter. Ignore and send the LBA.

2. You then get a letter again stating "Our charges are legal, but as a gesture of goodwill we will give you £****." Ignore and send your letter of rejection. Either full rejection or as I did that you accept that offer as part payment of what you are due.

3. In my case I waited 7 days then phoned the person that the second letter came from "John Denison" to confirm he had received my letter of rejection, that was on Friday 29th June. Over the phone he offered to sort out the situation there and then and offered me £2200.00. I had originally only claimed for £2029.00 as that is what the charges for 5 years amounted to, but they worked it out for 6 years as that is what they are offering in England.

Phoning them might not be seen as being the done thing, however it saved a heck of a lot of hassle with the court and was a far speeder outcome. Got the letter of confirmation on Monday 2 July.

The main thing is stick to the time scales on the letters, and when it reaches the final stages it depends on what track you wish to follow. I gained £180.00 more than I was claiming for, but lost on interest at the court stage, but saved time and hassle. GOOD LUCK. :cool:

i have literally just recieved a letter back from halifax also declining, my request of bank charge reversal, what is the best step to take next? thanks dodsy
